(GENERAL PERMITTED DEVELOPMENT) (ENGLAND) ORDER 2015 (AS AMENDED) (“THE ORDER”)

NOTICE OF THE MAKING OF ARTICLE 4(1) DIRECTION WITHOUT IMMEDIATE EFFECT RELATING TO THE REMOVAL OF PERMITTED DEVELOPMENT RIGHTS

Harlow Council on 3 March 2025 made an Article 4(1) Direction under Article 4(1) of the Order which withdraws permitted development rights in respect of various types of development comprised within Parts 1 and 2 of Schedule 2 of the Order. It is intended that the Direction will come into force on 4 March 2026.

The Direction applies to land in the Churchgate Street Conservation Area. The effect of the Direction is to require planning permission to be received for the development of the type to which the Direction relates.

The Direction, information about the development types listed in it, details of public exhibitions being held, an associated Draft Management Plan and Guidance document, and the plan showing the extent of the Direction can be viewed online at www.harlow.gov.uk/conservation-areas. They can also be viewed at Harlow Civic Centre, Old Harlow Library and Harlow Central Library during normal opening hours.

The start date of the period during which comments (representations) can be sent to the Council regarding the making of the Direction is 4 March 2025. The Council will consider any representations when deciding whether to confirm the Direction. Comments can also be made on the Draft Management Plan and Guidance document. The period ends at 5pm on 17 April 2025.

PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 (AS AMENDED)

NOTICE OF CHURCHGATE STREET CONSERVATION AREA BOUNDARY DESIGNATION

Notice is hereby given that Harlow District Council (“the Council”), in pursuance of Powers under Section 69 of the Planning (Listed Buildings and Conservation Areas) Act 1990 (as amended) (“the Act”), has amended the designation of the Churchgate Street Conservation Area. This Notice is given in accordance with Section 70 of the Act. The other requirements of the Section have also been complied with.

In Pursuance of Powers under Section 69 of the Act, the Council published an Appraisal of the Area in September 2024 which included Management Proposals, one of which was the amendment of the Area Boundary. Public consultation on the Appraisal and Management Proposals was held between 2 September 2024 and 30 October 2024.

Subsequently, the Area Boundary has been amended, resulting in the following effects which are listed ordered from north to south:

  • Exclusion of 3 & 4 Millhurst Tews;
  • Exclusion of the open space to the rear and north of these;
  • Exclusion of The Gables, Drakes Meadow;
  • Correction of 35 Sheering Road by including part of its curtilage which is not currently in the Area;
  • Exclusion of 22 & 26 High Street Road;
  • Inclusion of a second house (and part of Mill House which is not currently in the Area) and land to its rear;
  • Inclusion of 6 to 12 Churchgate Court;
  • Minor topographical corrections at Churchyard St. Mary’s in Sheering Road;
  • Correction of the certification of St. Mary’s & St. Hugh’s Church, and other minor topographical corrections as necessary.

The basis that has offered that boundary of the Area now runs along the logical hard edges and includes the land described above, excepting open land which has been included or excluded on the basis that it has been included previously in error.

The revised Area boundary was adopted at the Council Cabinet meeting of 13 February 2025 and the boundary change will take effect from 4 March 2025.
