Section 78 Planning Appeal on behalf of Amberleigh Projects Ltd.

Land North-East of A3 Northbound Interchange, Petersfield, Hampshire

Amberleigh Projects Ltd (the Appellant) has lodged a planning appeal regarding the above site following the refusal of outline planning permission by South Downs National Park Authority on 17th April 2024:

‘Outline planning application for the construction of a hotel (Use Class C1) and a cycle centre (mix of flexible Use Class E(a)(b)(c)) with all matters reserved except for access from B2070.’

The Appellant has invited the Inspector to determine the Appeal on the basis of an Amended Site Layout & Landscape Strategy.

An updated Design and Access Statement, Land Use and Green Infrastructure Plan, Access and Movement Plan, Building Height Parameters Plan and Flood Risk Assessment and Drainage Strategy has also been updated to reflect and explain the amendments sought to the proposals via the appeal.

The proposed changes are as follows:

  • Amendment A – Repositioning of the cycle centre: The footprint of the proposed cycle centre building has been adjusted to ensure it is situated outside of any area at risk of flooding.
  • Amendment B – Redesign of the cycle track: The ‘cycle loop’ within the site has been amended and now only crosses the PROW once, with priority given to users of the PROW.
  • Amendment C Revised proposals for the Public Right of Way crossing the site: The PROW has been widened to 2.4m and will comprise a mown path. Trees are set at least 5m away from the PROW, hedgerows 2.4m away. The style and vegetation will be cleared at the entrance to the PROW on the site’s southern boundary to improve its accessibility.
  • Amendment D Cycle Centre parking: Additional parking is provided for the cycle centre.
  • Amendment E – Access Design: Modifications to the detailed design of the vehicular access have been undertaken following post-decision dialogue with Hampshire County Council Highways.

A period of consultation is now being conducted to allow interested parties the opportunity to make comments on the amended details. If you wish to make any comments, please ensure that they are received no later than Friday 15th November 2024, via the following methods:

Please note that this is not a consultation run on behalf of South Downs National Park Authority. All comments received will be forwarded to the Planning Inspectorate for the Inspector’s attention and consideration, and copied to the National Park Authority, prior to the opening of the appeal Inquiry.
