What is planned?

THE NETWORK RAIL (LEEDS TO MICKLEFIELD
ENHANCEMENTS) ORDER 2024
ACQUISITION OF LAND ACT 1981

1. The Network Rail (Leeds to Micklefield Enhancements) Order 2024 which was
submitted by Network Rail Infrastructure Limited to the Secretary of State for
determination includes the land and the new rights described in the First Schedule.
2. This land and the land over which the new rights are to be acquired forms part of
an open space, as defined in the Act; that is, land laid out as a public garden, or
used for the purposes of public recreation, or a disused burial ground.
3. Notice is hereby given that the Secretary of State in exercise of her powers under
section 19(2) and paragraph 6(3) of Schedule to the Acquisition of Land Act 1981
(Act) in terms of section 19(1)(b) of, and paragraph 6 of Schedule 3 to the Act::
(i) has certified that the land described in the First Schedule hereto, being part
open space within the meaning of the said Act, does not exceed 209 square
metres in extent and that the giving in exchange of other land is unnecessary,
whether in the interests of the persons if any, entitled to rights of common or
other rights or in the interests of the public; and
(ii) has certified that when burdened with the rights described in the First Schedule,
will be no less advantageous to those persons in whom it is vested and other
persons, if any, entitled to rights of common or other rights, and to the public,
that it was before.
4. A map showing the land to which the certificate relates may be inspected at
Leeds Library, 18 Commercial Street, Leeds, LS1 6AL between the hours of
10:00 and 18:00 Monday to Wednesday and 10:00 and 19:00 on Thursdays
and 10:00 and 17:00 on Fridays and 10:00 and 16:00 on Saturdays. As well as,
Garforth Library and One Stop Centre, Lidgett Lane, Garforth, Leeds, LS25 1EH
between the hours of 09:00 and 17:00 on Mondays, Thursdays and Fridays
and 10:00 and 17:00 on Tuesdays and 09:00 and 19:00 on Wednesdays and
10:00 and 16:00 on Saturdays and is available to view and download online at:

5. The certificate becomes operative on the date on which this notice is first published.
A person aggrieved by the certificate may, by application to the High Court within
6 weeks from that date, challenge its validity on the ground that there has been a
failure to comply with any relevant statutory requirement relating to the certificate.
