TOWN AND COUNTRY PLANNING ACT 1990

ORDER PURSUANT TO SECTION 257 OF THE TOWN AND COUNTRY PLANNING ACT 1990 (TCPA 1990)

CRAWLEY BOROUGH COUNCIL (Council) has on the 17th July 2024 made the order referred to below in exercise of its powers under section 257 of the TCPA 1990 as amended by the Greater London Authority Act 1999 and any other enabling powers.

DIVERSION ORDER REFERENCE No. CR/2023/0197/S257

Applicant: abrdn UK Real Estate Fund

Location: LAND ADJ TO HYDEHURST LANE, NORTHGATE, CRAWLEY

Proposal: Crawley Borough Council (“the Council”) has made an order pursuant to s257 of TCPA 1990 and which it proposes to submit for confirmation.

The effect of the order if it is confirmed by the

Council will be that:-

1. the public path shown by a bold black line on the drawing numbered 11511 PL045 Rev B referred to and described in Part 1 of the Schedule to the order shall be diverted as provided in the Order;

2. a new public right of right of way shall be created at the location shown by bold black dashes on the drawing numbered 11511 PL045 Rev B as referred to and described in Part 2 of the Schedule to the Order;

3. references to drawing number 045 in the Order are references to the said drawing numbered

11511 PL045 Rev B;

4. any private rights of way over the highway affected by the order will be unaffected; and

5. any rights of statutory undertakers in respect any apparatus under, in, on, over, along or across any length of highway authorised to be stopped up pursuant to the order will remain unaffected.

The order can be inspected, at all reasonable hours free of charge at a place arranged with the case officer and copies of it may be obtained at a reasonable charge.

Any person can object to or make representations on the order, to the Council, within a period of 28 days following the date of publication of this notice. Anyone who wishes to comment on this proposal can do so online or in writing to the case officer quoting the application reference number to the address below. Verbal comments cannot be taken into account.
