NOTICE OF CONFIRMATION OF AN ARTICLE 4(1) DIRECTION

NOTICE is hereby given that the Council of the Borough of Middlesbrough confirmed a non-immediate Article 4(1) Direction on 29 May 2024 under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (“the Direction”).

The Direction removes permitted development rights for development consisting of a change of use of a building from a use falling within Class C3(dwellinghouses) of Schedule 1 to the Town and Country Planning (Use Classes) Order 1987 (as amended) to a use falling within Class C4(houses in multiple occupation) of that Schedule being development compromised within Class L(b) of Part 3 of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).

The Direction comes into force on 8 February 2025 and from that date a change of use from a dwellinghouse (Class C3) to a house in multiple occupation (Class C4) must not be carried out unless planning permission has been granted for the change of use.

The Direction applies to the entire area of the Borough of Middlesbrough shown edged red on the map attached to the Direction but excluding the area designated as the Mayoral development area for the Middlesbrough Development Corporation shown hatched blue on the map attached to the Direction. A copy of the Direction can be viewed at Middlesbrough House, 50 Corporation Road, Middlesbrough, TS1 2RH from 9.00a.m. to 4.30p.m. on weekdays (excluding Bank Holidays) or online at https:// www.middlesbrough.gov.uk/planning-for-houses-inmultiple-occupation/.
