THE HOUSES IN MULTIPLE OCCUPATION ARTICLE 4 (1) DIRECTION 2024
NOTICE OF THE MAKING OF AN ARTICLE 4 (1) DIRECTION 
NOTICE is hereby given that the Derby City Council being the appropriate local planning authority pursuant to a Cabinet resolution of the 10th January 2024 made a non-immediate Article 4(1) Direction on the 25th April 2024, under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 as amended. (“the Order”). 

Description of the development and the area to which the Direction applies
The Direction applies to the development set out in the Schedule below and to the Land within the area shown edged with a thick black line on the Plan in the Direction comprising the whole of Arboretum Ward and those parts of Abbey, Alvaston North, Darley, Mackworth & New Zealand, Normanton and Sinfin & Osmaston that are within the Ring Road as shown on the Plan. 

Statement of effect of the Direction 
The effect of the Direction is that permission granted by Article 3 of the Order shall not apply to the development specified in the Schedule below. This means that planning permission will be required to change a dwellinghouse use to use as a house in multiple occupation once the direction is in force. 

Proposed date for the Direction to come into force 
The Direction is made under Article 4 (1) of the Order and shall come into force, if confirmed, on 3rd May 2025. 

Schedule 
Development consisting of a change of use of a building from a use within Class C3 (dwellinghouse) of Schedule 1 to the Town & Country Planning (Use Classes) Order 1987 (as amended) to a use within Class C4 (house in multiple occupation) of Schedule 1 being development within Class L(b) of Part 3 to Schedule 2 of the Order and not being development within any other class.

Consultation 
Any person wishing to make written representations concerning the direction must submit these to the Council as from the date of this notice to Friday 31st May 2024.

All written representations received during this consultation and in the pre consultation in April will be taken into account by the Council when considering whether to confirm the Direction.
