The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended)

NOTICE PURSUANT TO SCHEDULE 3 OF MAKING AN ARTICLE 4(1) DIRECTION (with immediate effect)
NOTICE is hereby given that the Elmbridge Borough Council (‘the Council’) has made a Direction (‘the Direction’) under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (‘the Order’) on 7 March 2024.
The Direction applies to a defined area known as land off Land at Woodlands Lane, Cobham, Surrey, KT11 3QA shown edged in blue on the attached plan. Also Known as Land northwest of The Old Orchard Woodlands Lane Stoke D’Abernon Cobham Surrey KT11 3QA, and applies to the development of the descriptions set out below with reference to the relating classes of the said Order:
Class A of Part 2 of Schedule 2: The erection, construction, maintenance, improvement or alteration of a gate, fence, wall or other means of enclosure.
Class B of Part 4 of Schedule 2: The use of any land for any purpose for not more than 28 days in total in any calendar year, of which not more than 14 days in total may be for the purposes of -
a) The holding of a market;
b) Motor car and motorcycle racing including trials of speed and practising for these activities And the provision of the land of any moveable structure for the purposes of the permitted use.
The effect of the Direction is that it removes the permitted development rights for the type of development described above. As permission granted by Article 3 of the said Order shall not apply to this type of development, such development shall not be carried out within the defined area to which this Direction applies, unless planning permission is granted by the Council.

A copy of Direction (including a map defining the area affected) may be seen at the Council’s Offices at its Civic Centre, High Street, Esher, Surrey KT10 9SD, between Monday to Thursday 8.45am - 5pm and Friday 8.45am - 4.45pm or it can be viewed on the Council’s website at https://www.elmbridge.gov.uk/yourcouncil/communications/consultations-surveys-and-notices
Representations on the Article 4 Direction may be made in writing between 22 March 2024 to 21 April 2024.

Representations can be made by email to tplan@elmbridge.gov.uk or by post to: Planning Compliance Services, Elmbridge Borough Council, Civic Centre, Esher, KT10 9SD. Any representations must be received by 5pm on 21 April 2024 and include a name and a postal or email address.
The Article 4 Direction made will have immediate effect and shall remain in force until 00:00 (midnight) on 7 September 2024 and shall then expire unless it is confirmed by the Council of Elmbridge Borough on 6 September 2024.
