NOTICE OF CONFIRMATION OF PUBLIC PATH DIVERSION ORDER
UNDER SECTION 257
TOWN AND COUNTRY PLANNING ACT 1990, PUBLIC FOOTPATH No. 12 (Part)
PARISH OF NORTH WINGFIELD ORDER No 3 of 2023

1. North East Derbyshire District Council (the Council) gives notice that it has confirmed the above Order without modification.
2. The effect of the Order is to divert the whole width of that part of North Wingfield Public Footpath No 12 commencing at Point A (Ordnance Survey Grid Reference (“GR”) SK 42532 66013) and proceeding in a generally south south westerly direction to Point B (GR SK 42436 65726), for a distance of approximately 303 metres or thereabouts to a 2 metre wide tarmacadam-surfaced footpath on land to the West of Chesterfield Road, Holmewood in the Parish of North Wingfield, commencing from Point A (GR) SK 42532 66013) and proceeding in a curve in a generally south westerly direction for a distance of approximately 15 metres to Point C (GR) SK 42528 65999), then turning to a south easterly direction for approximately 10 metres to Point D (GR) SK 42532 65990), then turning in a curve to a generally west south westerly direction for approximately 68 metres to Point E (GR) SK 42469 65969), then turning into a crushed and compacted rolled stone surfaced footpath (MOT Type-1 to dust) 2 metres wide and continuing in a south westerly direction to Point F (GR) SK 42341 65851) for approximately 179 metres, then turning to a south, south westerly direction for approximately 41 Metres to Point G (GR) SK 42334 65812), then turning back into a 2 metre wide tarmacadam-surfaced footpath and continuing in a south easterly direction for approximately 133 metres to Point H (GR) SK 42427 65720), then turning to a north easterly direction for approximately 11 metres to the aforementioned Point B, a total distance of approximately 457 metres or thereabouts as shown on the order map.
3. A copy of the Confirmed Order and Order and Order map may be inspected free of charge at the District Council Offices at 2013 Mill Lane Wingerworth Chesterfield S42 6AG from 9:00 am to 4.30 pm Monday to Friday (excluding Bank Holidays) until 29th February 2024 A copy may also be viewed on the Councils website https://www.ne-derbyshire.gov.uk
4. The Order comes into force on the date on which the Council certifies that the terms of Article 2 have been complied with.
5. Any person aggrieved by the Order and wishing to question its validity, or any provision contained in the Order, on the ground that it is not within the powers of the Town and Country Planning Act 1990 or that any procedural requirement of the Act, or any regulation made under the Act has not been complied with in relation to the Confirmation of the Order, he or she may within six weeks from the 1st February 2024 make an application to the High Court.
