NOTICE UNDER ARTICLE 15(3), ARTICLE 16 AND REGULATION 5A OF APPLICATION FOR PLANNING PERMISSION

Proposed Development at Little Eaton Branch Line Greenway from the village of Little Eaton (south) to the village of Rawson Green (north). Part of the Key Cycle Network. Ordnance Survey Grid Reference: [437086](easting), [343528](northing)

I give notice that Robert Smith is applying to Derbyshire County Council for planning permission for the development of part of the former Midland Railway Ripley Branch Line to construct a 3m wide, 5.6 kilometre long surfaced strategic greenway between Duffield Road, Little Eaton (south) and A609 Rawson Green (north). The route would form part of the Key Cycle Network. The proposed development does not accord with the provisions of the development plan in force in the area in which the land to which the application relates to as it is within the Green Belt. The proposed development to which the application relates is situated within 10 metres of relevant railway land.
Members of the public may inspect copies of the application, plans and other documents submitted with it at Derbyshire County Council, County Hall, Matlock, Derbyshire, DE4 3AG, (available online at www.derbyshire.gov.uk), or at the Planning Department, Erewash Borough Council, Town Hall, Long Eaton, NG10 1HU (available online at www.erewash.gov.uk) and Planning Department, Amber Valley Borough Council, Town Hall, Market Place, Ripley, DE5 3BT (available online at www.ambervalley.gov.uk) during all reasonable hours until 14 January 2024. Anyone who wishes to make representations to the County Council about this application should do so by 14 January 2024,
- by writing to the Executive Director of Place , at the County Council postal address given above,
- by email to: planningrepresentations@derbyshire.gov.uk,or
-by using the facility for representations about current planning applications available on the Council’s website www.derbyshire.gov.uk.

Other Information: The development would affect a right of way to which Part 3 of the Wildlife and Countryside Act 1981 applies. The Council thinks that the development would affect the setting of some listed buildings and the character or appearance of a conservation area which part of the land to which the application relates to is in. 

The Council currently considers the proposed development does not accord with the provisions of the development plan under policies EN2 of the Amber Valley Borough Local Plan and Policy 3 of the Erewash Borough Local Plan which relate to the Green Belt.
