PUBLIC NOTICE OF INTENTION TO ISSUE A CERTIFICATE PARAGRAPH 6(1 )(a) OF SCHEDULE 3 TO THE ACQUISITION OF LAND ACT 1981

Land known Ham Village Green
1. The London Borough of Richmond Upon Thames ("the Council") has submitted the London Borough of Richmond Upon Thames (Ham Close) Compulsory Purchase Order 2023 ("the Order") to the Secretary of State for Levelling Up, Housing and Communities for confirmation. If confirmed, the Order will authorise the purchase of land ("the Order Land"), and new rights over land ("the Rights Land") which forms part of an open space, as defined in the Acquisition of Land Act 1981 ("the Act"); that is, land laid out as a public garden, or used for the purposes of public recreation, or a disused burial ground.
2. The Order will be subject to special parliamentary procedure unless the Secretary of State for Levelling Up Housing & Communities gives a certificate in accordance with the provisions of paragraph 6(1 )(a) of Schedule 3 to the Act. The Secretary of State has been asked by the Council to certify: under paragraph 6(1 )(a) of Schedule 3 that the Rights Land, when burdened with the rights to be acquired, will be no less advantageous to those persons in whom it is vested and other persons, if any, entitled to rights of common or other rights, and to the public, than it was before.
3. The Rights Land and the rights which are to be acquired over it are described in the Schedule to this notice. On the plan referred to in paragraph 5 below ("the Order Plan"), the Order Land is shown coloured red and the Rights Land is shown coloured blue.
4. The Secretary of State for Levelling Up Housing & Communities is required to direct the Council to give public notice of his intention to give a certificate before he reaches a decision, to afford an opportunity for representations and objections to be made. The Council hereby gives that notice. Any representations or objections in relation to this proposal should be addressed in writing to:

5. Copies of the Order, the Order Plan showing the Rights Land and a plan of the open space are on deposit at:
i. Civic Centre, 44 York Street, Twickenham TW1 3BZ (Monday to Friday, 9.00am - 5:00pm). Please note opening times at the Civic Centre differ over Christmas and New Year. The Civic Centre will be closed on 25th, 26th December 2023 and 1st January 2024;
ii. Ham Library, Ham Street, TW10 7HR (9:30am - 6.00pm on Mondays, 9:30am - 6.00pm on Tuesdays, 10.00am - 7.00pm on Wednesdays, 9:30am - 6.00pm on Fridays and 9:30am - 4.00pm on Saturdays). Please note the opening times at Ham Library differ over Christmas and New Year. The library will be closed on 25th, 26th December 2023 and 1 st January 2024; and

6. The Secretary of State for Levelling Up Housing & Communities may, if he considers it expedient, hold a public inquiry into the matter.
