REDEVELOPMENT AT CAMBRIDGE ROAD ESTATE, BLOCK C STOPPING UP ORDER NO.3 2023 NOTICE OF MAKING OF A STOPPING UP ORDER
SECTION 247 TOWN AND COUNTRY PLANNING ACT 1990
NOTICE IS HEREBY GIVEN that the Council of the Royal Borough of Kingston upon Thames, 2 High Street, Kingston upon Thames, KT1 1EU (hereinafter called "the Council") has made an order ("The Order") pursuant to section 247 of the Town and Country Planning Act 1990 (hereinafter called "the Act") in respect of:
- the area of the highway relating to Block C encompassing Area A comprising an area of 784.8367 m2,
- the area of the highway relating to Block C encompassing Area B comprising an area of 388.9402 m2, and
- the area of the highway relating to Block C encompassing Area C comprising an area of 679.9157 m2, and
and consisting of footpaths between the northern boundary line of Eureka Road, west of St Peters Road and east of Washington Road, between 1 - 27 Grantchester, 1-60 Madingley, 1-27 Fulbourn and 1-18 Comberton ("the Footpaths").
The effect of the Order is that the said land ceases to be public highway. The Council is satisfied that it was necessary to stop up the Footpaths that are subject to this Order to allow for the implementation of the planning permission described in the Schedule below.
A copy of the Order and a map defining the land to which it relates can be inspected at Council Offices at Reception, Guildhall, Kingston upon Thames, KT1 1 EU, from 9.00am to 5.00pm Monday to Thursday and 9.00am to 4.45pm on Friday (excluding bank and public holidays)
Any person aggrieved by the Order and wishing to question its validity, or any provision contained in the Order, on the grounds that it is not within the powers of the Act or that any procedural requirements of the Act or any regulation made under the Act has not been complied with in relation to the making of the Order may, within 6 weeks up to 11th January 2024 apply to the High Court for the suspension or quashing of the Order or of any provision contained in the Order.
THE SCHEDULE Planning permission Council reference number 20/02942/FUL Part detailed I part outline planning permission for a mixed use development, including demolition of existing buildings and erection of up to 2,170 residential units (Use Class C3), 290sqm of flexible office floorspace (Use Class E), 1,395sqm of flexible retail/commercial floorspace (Use Class E/Sui Generis), 1,250sqm community floorspace (Use Class F2), new publicly accessible open space and associated access, servicing, landscaping and works, including stopping up of all public highway including Somerset Road, Wimpole Close, Eureka Road. St. Peters Road, Burritt Road, Stapleford Close, Willingham Way, Chesterton Terrace, Excelsior Close, Washington Road, Somerset Road and Franklin Close, various footpaths, parking courts and other areas of highway. Detailed permission for Phase 1 for erection of 452 residential units (Use C/ass C3), 1,250sqm community floorspace (Use Class F2), 290sqm of flexible office floorspace (Use Class E), 395sqm of flexible retail/commercial floorspace (Use Class E/Sui Generis), new publicly accessible open space and associated access, servicing, parking, landscaping works including tree removal, refuse/ recycling and bicycle storage, energy centre and works. Outline permission for 1718 residential units (Use class C3), 1000 sqm of flexible retail/commercial floorspace (Use Class E/Sui Generis) (with scale, layout, appearance, and landscaping reserved) is sought for the remainder of the development (parameter plans are included).
