ORDER NO 2, 2023
CLAIMED PUBLIC FOOTPATH,
CITY FIELDS, WAKEFIELD
The above order was made on 6th November 2023 to enable the applicant to implement planning permission number 22/01948/FUL, under Part III of the Town and Country Planning Act 1990, namely to enable the construction of a housing development of 135 units.
The effect of the order will be to divert a claimed public right of way as shown by a solid line on the plan annexed hereto commencing at its junction with Public Footpath Stanley No.27 on the plan at Point A on the map at Grid Reference SE 3491 2205 proceeding in a south easterly direction for
250 metres to point B at Grid Reference SE 3509 2186 then a southerly direction for 138 metres to point C on the plan at Grid Reference SE 3507 2174 to a public bridleway 3.0 metres wide shown by a bold dashed line on the plan annexed hereto commencing at its junction with Public Footpath
Stanley No.27 at Point D on the map at Grid Reference SE 3491 2205 proceeding in a generally southerly direction for 125 metres then a generally south easterly direction 220 metres to Point E at Grid Reference SE 3497 2170 then generally in an easterly direction for 108 metres to point C at Grid Reference SE 3507 2174. The diversion of the claimed public footpath shall have effect on the date of which the Council of the City of Wakefield certify that the alternative highway for use as a replacement for the said claimed public footpath has been created to the reasonable satisfaction of the Council of the City of Wakefield and upon the occurrence of that diversion the Council of the City of Wakefield definitive map shall be modified by deleting from it the path or way referred to in paragraph 1 of the order and the definitive statement shall be modified as described in Part 3 of the Schedule to the order.

Any representations about or objections to the
Order may be sent in writing to the Chief Legal
Officer, Wakefield One, Burton Street, Wakefield,
WF1 2EB (quoting ref L/AF) not later than 7th December 2023. Please state the grounds on which they are made.
If no such representations or objections are duly made, or if any so made are withdrawn, The Council of the City of Wakefield may itself confirm the order as an unopposed order. If the order is sent to the Secretary of State for The Environment for confirmation any representations or objections which have not been withdrawn will be sent with the order.
