TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT) (ENGLAND) ORDER 2015 AS AMENDED

NOTICE OF THE MODIFICATION OF A DIRECTION UNDER ARTICLE 4(1)

Notice is given that the Secretary of State for Levelling Up, Housing and Communities has modified a direction made by the London Borough of Islington under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015.

The Article 4 direction applies to parts of the Central Activities Zone and Central Activities Zone Fringe in the King's Cross area within the London Borough of Islington. The effect of the modification is to exclude from the direction a site known as Angel Gate located at Goswell Road, London, EC1V 2PT.

The modified Article 4 direction came into force on 19 October 2023.

The Article 4 (1) direction originally confirmed by the London Borough of Islington on 31 August 2023 withdraws the permitted development right granted by Schedule 2 Part 3 Class MA of the Order, namely making a change of use of a building and any land within its curtilage from a use falling within Class E (commercial, business and service) of Schedule 2 to the Town and Country Planning (Use Classes) Order 1987 to a use falling within Class C3 (dwellinghouses) of Schedule 1 of that Order.

As a result of the modified Direction, permission granted by Part 3 of the Order shall not apply to the development specified above and such development shall not be carried out within the areas to which the Direction applies, unless planning permission is granted by the Council.

A copy of the Article 4 direction, the direction from the Secretary of State modifying the Article 4 Direction, and maps defining the parts of the Central Activities Zone and Central Activities Zone Fringe in the King's Cross area within the London Borough of Islington to which the Article 4 Direction as now modified applies can be viewed online at www.islington.gov.uk/permitteddevelopment; and at Islington Town Hall, Upper Street, N1 2UD (9am-5pm Monday to Friday).
