What is planned?

LONDON BOROUGH OF TOWER HAMLETS - INITIAL DEMOLITION NOTICE

Under Schedule 5A of the Housing Act 1985 as inserted by clause 182 of the Housing Act 2004

This Notice is given by the London Borough of Tower Hamlets, of Town Hall, 160 Whitechapel Road, London, E1 1BJ ("the Council") and in accordance with Schedule 5A of the Housing Act ("the Act").

1. INTENTION TO DEMOLISH

It is the intention of the Council to demolish the buildings listed below ("the Relevant Premises"): 1-48 Harriott House, Jamaica Street, London, E1 3DT 1-36 Apsley House, Stepney Way, London, E1 3DS 1-16 Pattison House, Wellesley Street, London, E1 3DR Redcoat Community Centre & Mosque, 256 Stepney Way,

London, E1 3DW

260 Stepney Way, London, E1 3DW

2. REASONS FOR DEMOLITION

The reason for the intended demolition is that the Relevant Premises are within an area subject to a comprehensive redevelopment scheme which will allow the building of 400 plus new homes and facilities and the improvement of the area. The demolition of the Relevant Premises is necessary for the regeneration of Harriott, Apsley, Pattison Houses ("HAP").

3. PROPOSED DEMOLITION PERIOD

The Council intends to demolish the Relevant Premises between the period of (27th September 2027) and (27th September 2030).

4. DURATION OF THIS NOTICE

The Notice is being served on all the Council's secure tenants of the Relevant Premises and will remain in force until 27 September 2030 unless extended, revoked or otherwise terminated by virtue of paragraph 3 of Schedule 5A of the Act.

5. EFFECT OF THIS NOTICE

This Notice does not prevent a secure tenant submitting a Right to Buy claim, or the taking of any steps under Part V of the Act in connection with any such claim up to the point where section 138(1) of the Act would otherwise operate in relation to such a claim, or the operation of that provision in most circumstances where the Notice ceases to be in force, but if the Council subsequently serves a Final Demolition Notice in respect of the Relevant Premises, the right to buy will not arise in respect of any of those premises while that Notice is in force and any existing claim will cease to be effective. Whilst this Notice is in force, the Council will not be under any obligation to make a freehold transfer or grant a lease under Section 138(1) of the Act in respect of any claim by a secure tenant to exercise a Right To Buy claim in respect of any dwelling that is contained in the Relevant Premises.

6. RIGHT TO COMPENSATION

Where this Notice has been served on a secure tenant, who has an existing Right to Buy claim at the date of service of this Notice, Section 138C of the Act gives that tenant a right to compensation in respect of certain expenditure incurred in relation to that claim. Compensation under Section 138C of the Act is compensation in respect of expenditure reasonably incurred by secure tenants before the operative date of this Notice in respect of legal and other fees, and other professional costs and expenses payable in connection with the exercise of the existing Right to Buy claim. Any claim for compensation must be supported by receipts or other documents showing that the secure tenant incurred the expenditure in question and must be served on the Council in writing within three months of the date of this Notice.

OPERATIVE DATE

The operative date of this Notice is 12th October 2023, which is the date that a copy of this Notice was served on the tenants of the Relevant Properties.

EXTENSION PERIOD AND NOTICE PUBLICATION

The Council can apply to the Secretary of State for an extension of the period that this Notice is in force. A Public Notice confirming the demolition of the Relevant Premises has been placed in a local newspaper, and on the Council's website.
