DESIGNATION OF THE WEST VALE CONSERVATION AREA

NOTICE is hereby given that on the 7th August 2023 the Borough Council of Calderdale (“the Council”) determined that the area described in the Schedule to this Notice is an area of special architectural or historic interest the character or appearance of which it is desirable to preserve or enhance and has accordingly designated the area as a conservation area which is to be known as the West Vale Conservation Area.
The principal effects of this area being designated as a conservation area are as follows:
1. In carrying out any functions under the Planning Acts in relation to the conservation area, the Council and the Secretary of State are required to pay special attention to the desirability of preserving or enhancing the character or appearance of the conservation area.
2. Consent is required for the demolition of buildings (other than excepted buildings), and may be needed for the demolition of gates, fences, railings and walls exceeding certain heights, in the conservation area.
3. Planning applications for development which would, in the Council’s opinion, affect the character or appearance of the conservation area must be given special publicity.
4. Six weeks’ notice in writing must be given to the Council before any works are carried out to a tree in the conservation area. It is a criminal offence to cut down, top, lop, uproot, wilfully damage or wilfully destroy a tree in the conservation area without giving this written notice.
5. Permitted development rights under the Town and Country Planning (General Permitted Development) (England) Order 2015 are more restricted than in other areas and planning permission may now be required for certain works.
6. The Council is under a duty to formulate and publish proposals for the preservation and enhancement of the conservation area.
7. There are certain restrictions over the display of advertisements and express consent from the Council for certain types of advertisement is required.

SCHEDULE - WEST VALE CONSERVATION AREA
The designation of West Vale Conservation Area includes all land and buildings inside the conservation area boundary comprising the following areas:
a) Area known as Clay House Park south of Clay House Lane and west of Stainland Road, including Clay House, Clay House Barn, south side of Baxter Lane, and 24 and 26 Rochdale Road.
b) Area south-east of Stainland Road and east of Alfred Street, including North Dean Mills Stainland Road, Prospect Mills Church Street, Land adjacent to Church Street, Solar Works Church Street, Portland House Calder Street, and Units 1-3 Calder Street.
c) Area east of the junction of Rochdale Road and Stainland Road, including West Vale Academy, Civic Hall, West Vale Baptist Chapel, North Dean Chapel of Rest, Church of St John the Evangelist, and The Studio Church Street.
d) Area east of and including Railway Viaduct Over Stainland Road, including all land and buildings north of Stainland Road and south of Saddleworth Road, and west of the junction of Stainland Road and Saddleworth Road.
e) Area north-east of Hullenedge Lane, Queen Street and Featherbed Lane, including Middle Dean Street, High Street, Victoria Street, Union Street, George Street, North Street, Workhouse Lane, Cross Street, Green Lane, Nab End Land, Ely Street, Exchange Lane, Garwick Terrace, Saddleworth Road east of Green Lane and Rochdale Road east of Lambert Street.
f) The main commercial centre along the length of Stainland Road south of Clay House Park and north of Railway Viaduct over Stainland Road, including Maude Street, Elizabeth Street, Lambert Street, Green Lane north of Saddleworth Road, and Rochdale Road south-east of Clay Park and north-west of Lambert Street.
