NOTICE OF ACCEPTANCE OF AN APPLICATION
FOR A DEVELOPMENT CONSENT ORDER BY THE PLANNING INSPECTORATE (ON BEHALF OF THE SECRETARY OF STATE) UNDER SECTION 56 OF THE PLANNING ACT 2008
GATE BURTON ENERGY PARK DEVELOPMENT CONSENT ORDER
REGULATION 9 OF THE INFRASTRUCTURE PLANNING (APPLICATIONS: PRESCRIBED FORMS AND PROCEDURE) REGULATIONS 2009
REGULATION 16 OF THE INFRASTRUCTURE PLANNING (ENVIRONMENTAL IMPACT ASSESSMENT) REGULATIONS 2017
Notice is hereby given that the Secretary of State has accepted an application by Gate Burton Energy Park Limited (company number 12660764) of Stirling Square, 5-7 Carlton Gardens, London, United Kingdom, SW1Y 5AD (“the Applicant”) for a Development Consent Order under the Planning Act 2008. The Application (Reference No. EN010131) was submitted by the Applicant to the Secretary of State c/o the Planning Inspectorate on 27th January 2023 and was accepted on 22nd February 2023.
Summary of the Project
The proposed Gate Burton Energy Park lies within the administrative areas of Bassetlaw District Council and West Lindsey District Council, and at county level within Nottinghamshire County Council and Lincolnshire County Council. The Application is for development consent for the construction, operation and maintenance and decommissioning of solar photovoltaic (PV) generating panels with a total capacity exceeding 50 megawatts (MW) and on-site energy storage facility together with grid connection infrastructure at a proposed site in Lincolnshire and Nottinghamshire (“the Scheme”).
A map showing the location of the Scheme can be viewed on the National Infrastructure Planning website at the following link: https://infrastructure.planninginspectorate.gov.uk/wp-content/ipc/uploads/projects/EN010131/EN010131-000390-EN010131%20APP%205.1%20Location%20Plan.pdf
Development consent is required to the extent that development is or forms part of a Nationally Significant Infrastructure Project pursuant to section 14(1)(a) and 15(1) and 15(2) of the Planning Act 2008, as an onshore generating station in England with a capacity exceeding 50 MW. It is for this reason that the project falls within the remit of the Secretary of State’s decision making powers.
The Development Consent Order would enable the acquisition of land, new rights over land and the imposition of restrictions that are required to construct, operate and maintain the Scheme. In addition, it contains powers for the possession and use of land on a temporary basis to facilitate the construction of the Scheme.
Environmental Impact Assessment Development:
The proposed works are environmental impact assessment (EIA) development for the purposes of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2017 and accordingly an Environmental Statement (ES) accompanies the application.
