Notice of application for provisional grant of licence for premises in which the business carried on under the licence is the business of selling intoxicating liquor by retail for consumption either in or off the premises
IN THE COUNTY COURT

TAKE NOTICE that EAGLE-GLEN LIMITED having its registered office at 46A Rainey Street, Magherafelt, Co. Derry BT45 5AH intends to apply to the County Court sitting at the Courthouse, Laganside Court, Oxford Street, Belfast commencing at 10.30 a.m. on 5 January 2026 for the provisional grant of a licence for the premises situated at 1 Hill Street and 26-40 Waring Street, Belfast being such premises as are specified in Article 5(1)(a) of the Licensing (Northern Ireland) Order 1996, namely, premises in which it is intended to carry on the business of selling intoxicating liquor for consumption either in or off the premises

AND TAKE NOTICE that this application will be dealt with by the court on 8 January 2026, commencing at 10.30 am.
The following body corporate owns the business to be carried on under the licence: EAGLE-GLEN LIMITED a limited liability Company of which the following persons are directors and executive controllers,
John Downey of 21 Drumard Road, Magherafelt, Co. Derry, BT45 8QA
Henry Downey of 27 Drumard Road, Magherafelt, Co. Derry, BT45 8QA
Seamus Downey of 17A Drumard Road, Magherafelt, Co. Derry, BT45 8QA
The owner of the premises is Birch Village Company Limited.
In accordance with Schedule 1 to the said Order and Rule 6 of Order 48 of the County Court Rules (Northern Ireland) 1981, we attach to this notice a plan of the premises delineating
(a) the part or parts thereof in which intoxicating liquor is to be sold; and
(b) the extent of the premises which are or are to be extended, used or demolished.
There is in force planning permission to use the premises as premises of the kind specified in this notice for the period during which the licence would be in force and a copy of the planning permission is attached;
FURTHER TAKE NOTICE that EAGLE-GLEN LIMITED intends to apply under Article 44 of the said Order for an order of the above-named court directing that, on such days as may be specified in the order, the hours mentioned in Article 44(2) of the said Order shall, in addition to those mentioned in Article 42(1) of the said Order, be included in the permitted hours for the part(s) of the premises delineated on the said plan on the grounds that the said part(s) of the said premises is/are-
(a) structurally adapted and used, or intended to be used, for the purpose of habitually providing for the accommodation of persons frequenting the premises;
(i) musical or other entertainment; or
(ii) substantial refreshment; or
(iii) both such entertainment or refreshment and
(b) the sale of intoxicating liquor is ancillary to that entertainment or refreshment.
AND FURTHER TAKE NOTICE that EAGLE-GLEN LIMITED intends to apply under Article 44(A)(3) of the said Order for an order directing that on not more than 104 days per year being days specified in the said Article 44 Order, an additional hour beginning immediately after the end of the period authorised by the said Article 44 Order. The dates of the specified 104 days will be available for inspection at the offices of the Applicant’s solicitors by appointment.
The licence required for the premises for which the application is made by a council under Schedule 1 to the Local Government (Miscellaneous Provisions) (Northern Ireland) Order 1985 will be produced at the hearing of the application.
A subsisting licence as defined in Schedule 2 of the said Order for premises such as are specified in Article 5(1)(a) situated at 1 Hill Street and 26-40 Waring Street, Belfast will be surrendered to the court.
NOTE: Any person owning, or residing or carrying on business in premises in the vicinity of the premises for which the licence is sought who intends to object to the grant of the licence must, in accordance with paragraph 6 of Schedule 1 the said Order, serve notice of his intention to object upon the applicant and the Chief Clerk not less than one week before 5 January 2026 briefly stating his grounds for objection.
The grounds of objection are such as are specified in Article 7(4)(a) to (e)(i) namely
(a) failure to comply with the correct procedure; or
(b) that the Applicant is not a fit person to hold a licence; or
(c) that the premises are not of the kind specified in the notice or are not suitable to be licensed for the sale of intoxicating liquor by retail; or
(d) that the number of licensed premises of that kind in the vicinity of the premises for which the licence is sought is, or having regard to the licences provisionally granted under Article 9 or any sites approved under Article 10 will be adequate;
and such as are specified in Article 44(1) and (3) namely
(a) that the parts of the premises specified in the application are not structurally adapted; or (b) that the additional hours will cause undue inconvenience to persons residing in the vicinity; and such as are specified in Article 44A(5) or (7) namely
(a) that the premises will not be used for the provision of musical or other entertainment or substantial refreshment or both during the additional hours; or
(b) that the business to be conducted during the additional hours will cause undue inconvenience to persons residing in the vicinity; or
(c) that the additional hours will cause undue inconvenience to persons residing in the vicinity; Dated this 12 December 2025
