What is happening?
PUBLIC NOTICE
ABANDONED VESSELS – MFV Ambitious SY 916 and MFV Stormy C GY 451
Stornoway Port Authority, as Statutory Harbour Authority for Stornoway Harbour, hereby gives notice pursuant to the Harbours Docks and Piers Clauses Act 1847, the Harbours Act 1964, the Merchant Shipping Act 1995 and the Stornoway Harbour Act and Orders 1976 to 2021.
The vessels described below have been abandoned within the Stornoway Port Authority harbour limits. Vessels: MFV Ambitious SY916, Official Number A24061 (“Ambitious”), and
MFV Stormy C GY451, Official Number C20273 (“Stormy C”) and together “the vessels”
The vessels are in a condition such that they are considered unfit for service, sunk, stranded and abandoned, wrecks and/or likely to become an obstruction or danger to navigation.
The owner, master, or any person with a legal interest in the vessels is hereby required to contact the undernoted in writing within 14 days of the publication of this notice and provide satisfactory evidence of ownership, together with written proposals, satisfactory to Stornoway Port Authority, for the removal of the vessels from the harbour limits and payment of all debts relating to the vessels forthwith.
If no contact is made within this time, Stornoway Port Authority, as Statutory Harbour Authority, intends to exercise its statutory powers under section 252 of the Merchant Shipping Act 1995 to take possession of, raise, remove, destroy, sell or otherwise dispose of the vessels.
The vessels may be disposed of or sold in such manner as Stornoway Port Authority see fit, and the proceeds applied towards the costs of removal, storage, and sale. Any balance after deduction of outstanding harbour dues and costs incurred will be held for the owner for a period of 28 days.
Stornoway Port Authority invites written offers to purchase the Stormy C and remove it from the harbour within 14 days of publication of this notice.
At any time before any property, including the vessels, is sold the owner of such property, on exhibition of proof of ownership, shall be entitled to have the property delivered to him on payment of its fair market value to the Harbour Authority, pursuant to section 252(6) of the Merchant Shipping Act 1995.
All reasonable costs incurred by Stornoway Port Authority in relation to the vessels shall be recoverable from and payable by the owner prior to delivery of the vessels.
This notice is written without prejudice to any other powers of Stornoway Port Authority.
