IN THE BOROUGH OF ASHFORD NOTICE OF CONFIRMATION OF PUBLIC PATH ORDER HIGHWAYS ACT 1980 WILDLIFE AND COUNTRYSIDE ACT 1981 THE KENT COUNTY COUNCIL (PUBLIC FOOTPATH AT76 (PART), WITTERSHAM) PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2025

On 10 November 2025 The Kent County Council confirmed the above Order under Section 119 of the Highways Act 1980.

The effect of that Order as confirmed is to divert the entire width of that length of public footpath numbered AT76, which commences on an unaffected length of public footpath AT76 at NGR TQ 8939 2864 (Point A) and travels in a northerly direction for 37 metres to NGR TQ 8938 2868 (Point B), then continues in a north easterly direction for 21 metres to another unaffected length of public footpath AT76 at NGR TQ 8949 2879 (Point C). As shown by the bold continuous line between points A-B-C on the Order Plan and will add a new length of public footpath numbered AT76, with a width of 2.5 metres, which commences at the aforementioned Point A and travels in a north northeasterly direction for 41 metres to NGR TQ 8940 2868 (Point D), then travels in a northwesterly, then northerly direction for 18 metres to the aforementioned Point C. As shown by the bold broken line between points A-D-C on the Order Plan.

Notice is hereby given that on the 24th October 2025, Kent County Council (on behalf of Ashford Borough Council) certified that the terms of Article 2 of the above-named Order, requiring an alternative highway to be created to the reasonable satisfaction of the Kent County Council (on behalf of Ashford Borough Council) had been complied with.

Accordingly, the above-named Order has now taken effect.

On 12 November 2025 Kent County Council confirmed the above Order under section 257 of the Town and Country Planning Act 1990 and on the same day, 12 November 2025, the Kent County Council certified that the terms of Article 2 have been complied with, and as such the order has come into effect.

The effect of the Order, as confirmed, is to divert the entire width of that length of public footpath numbered DB53, which commences at NGR TQ 54511 73915 (Point A) and travels in a southeasterly direction for 2.5 metres to NGR TQ 54512 73913 (Point B), then continues in an east northeasterly for 12 metres to NGR TQ 54523 73919 (Point C). As shown by the bold line between Points A-B-C on the Order Plan and will add a new length of public footpath numbered DB53 with a width of 2.0 metres, which commences at the aforementioned Point A, and travels in an east northeasterly direction for 13 metres to the aforementioned Point C. As shown by the bold broken line between Points A-C on the Order Plan. All directions are general, all distances are approximate.

The Order came into force on the 12 November 2025 when Kent County Council certified that the terms of article 2 of the Order have been complied with, but if any person aggrieved by the Order desires to question its validity or that of any provision contained in it on the ground that it is not within the powers of the above Act, or on the ground that any requirement of that Act, or any regulation made under it has not been complied with in relation to the confirmation of the Order, he or she may apply to the High Court for any of these purposes under section 287 of the Town and Country Planning Act 1990 within 6 weeks from the date on which notice is first published as required by paragraph 7 of Schedule 14 to that Act.

On 22 October 2025 the Kent County Council confirmed the above Order without modifications.

The effect of the Order as confirmed is to modify the Definitive Map and Statement for the area by adding a Bridleway numbered EE504, with a width of 3.0 metres, which commences at its junction with Fleming Road at NGR TR2963 5668 (Point A) and runs in a south, south southwest and southwest direction for 690 metres to its junction with Bridleway EE201 and Public Footpath EE203A at NGR TR 2930 5610 (Point B). The path continues on the southern side of EE201 and runs in a southwest direction for 380 metres to its junction with Sandwich Road at NGR TR 2900 5587 (Point C). Between the points A-B-C on the Order plan.

The above Order was made on 29 October 2025 under section 53 of the Wildlife and Countryside Act 1981. If confirmed, it will modify the Definitive Map and Statement for the area by deleting the full width of that part of public footpath numbered TB48, which commences on Park Avenue at NGR TR 38621 66658 (point A) and runs north for 139 metres to its connection with Grange Way at NGR TR 38626 66797 (point B), as shown between the points A-B on the Order plan.

The above Order, if confirmed, will also add a public footpath numbered TB48, with a width of 2.0 metres, which commences on Park Avenue at NGR TR 38615 66648 and runs north and north north-east for 151 metres to the aforementioned point B, as shown between the points C-B on the Order plan.

The effect of that Order as confirmed is to divert the entire width of that length of public footpath numbered ZR281 which commences at NGR TQ 9325 5741 (Point A) and travels in a northwesterly direction for 285 metres to NGR TQ 9309 5763 (Point B), then continues in a west northwesterly direction for 355 metres to NGR TQ 9280 5782 (Point C), then continues in a northerly direction for 59 metres to NGR TQ 9280 5788 (Point D) where it terminates at its junction with Down Court Road. As shown between Points A-B-C-D on the Order Plan and will a new length of public footpath numbered ZR281 with a width of 2.0 metres which commences at the aforementioned Point A and travels in a northwesterly direction for 398 metres to NGR TQ 9291 5760 (Point E), then continues in a west northwesterly direction for 181 metres to NGR TQ 9274 5767 (Point F), then continues in a north northeasterly direction for 155 metres to NGR TQ 9278 5782 (Point G), then continues in a northerly direction for 54 metres to NGR TQ 9278 5787 (Point H) where it terminates at its junction with Down Court Road.
