NOTICE OF CONFIRMATION OF A MODIFICATION ORDER

SECTION 53 OF THE WILDLIFE AND COUNTRYSIDE ACT 1981

The Definitive Map and Statement of Public Rights of Way for the County of Lancashire

LANCASHIRE COUNTY COUNCIL
ADDITION OF RESTRICTED BYWAY ALONG OLD CLAY LANE, LONGRIDGE AND DELETION OF FOOTPATH Definitive Map Modification Order 2025

On the 4th day of August 2025 Lancashire County Council confirmed the above Order.

The effect of the Order as confirmed is to modify the Definitive Map and Statement of Public Rights of Way for the area, by recording a Restricted Byway known as Old Clay Lane from the open junction with Inglewhite Road, opposite Belmont Garage running in a north easterly direction along a wide bounded strip of land with a stone surfaced track running along it for approximately 140 metres and then continuing as an unsurfaced route along a wide bounded strip of land to the parish and district boundary where it passes through a gateway to continue in a north easterly direction crossing a shallow watercourse and then continuing along a wide strip of land partially bounded by fences and hedges and a stone wall to pass through a second gate south east of the property known as Tile Croft. The route then continues for a short distance adjacent to Tile Croft beyond which the route continues through to Longridge Road along the tarmac access drive to 'Tile Croft'. The route ends at the junction with Longridge Road at Cockleach Lane Ends; a total distance of 750 metres.

The Order will also delete the following routes:

The full unrecorded width of the Footpath recorded as FP0609004 in the parish of Whittingham from a point on Inglewhite Road, Whittingham opposite Belmont Garage following the boundary hedge/fence along the northwest side of Old Clay Lane to the field boundary/watercourse on the parish and district boundary from where it is referenced as FP0341068.

The full unrecorded width of the Footpath recorded as FP0341068 in the parish of Thornley-with-Wheatley continuing from FP0609004 at the field boundary/ watercourse on the parish and district boundary following the boundary hedge/fence/wall along the northwest side of Old Clay Lane to Longridge Road at Cockleach Lane Ends.

The total distance of the routes to be deleted is 750 metres.

The Order took effect on the 04 August 2025 but if a person aggrieved by the Order desires to question the validity on the grounds that it is not within the powers of Section 53 of the Wildlife and Countryside Act 1981, or that any of the requirements of Schedule 15 to the Act have not been complied with in relation to the Order, he may, under Paragraph 12 of Schedule 15 to the Act, within 42 days from the date of publication of this Notice, make an application for the purpose to the High Court.
