NOTICE OF APPLICATION FOR THE
TRANSFER OF A LICENCE

TAKE NOTICE that we, Nicos Takeaway Ormeau Ltd (“the Applicant”), Company Number NI725480, having our registered office situate at 61 Ballygowan Road, Belfast, BT5 7LJ, intend at the Magistrates Court sitting at Laganside Courts, 45 Oxford Street, Belfast, BT1 3LL on the 30th day of September 2025 at 10.30 a.m. to apply for a Transfer to us of a Licence at present held by Stephen and Nicola Lawless of 17 Lagmore View Gardens, Belfast, BT17 0FR for the premises at Retail Unit 1, 114-116 Ormeau Road, Belfast being Restaurant premises of the following kind according to the Licensing (Northern Ireland) Order 1996 namely premises specified in Article 5(1) (e) (other than those referred to in Article 5(1)(a) of the Order) structurally adapted and used, or intended to be used, for the purpose of providing persons frequenting the premises with a main table meal at midday or in the evening, or both.
Nicos Sunnyside Street Limited of 61 Sunnyside Street, Belfast, BT7 3EG currently hold the licence by way of Protection Order granted on 8th April 2025.
The Applicant, a private limited company, is the body corporate that owns the business to be carried on under the licence of which the following persons are directors: Kristian Nicolo of 61 Ballygowan Road, Belfast, BT5 7LJ and Stephen Toney of 17 Ava Crescent, Belfast, BT7 3DU.
The owners of the premises are Dr Alasdair McDonnell, Dr Deirdre O’Hare, Dr Claire Diamond and Dr Damien McNally, all of Ormeau Road Health Centre, 120 Ormeau Road, Belfast.
The licence will be deposited with the Clerk of Petty Sessions before or at the hearing of the application.
AND FURTHER TAKE NOTICE that any person owning or residing or carrying on business in premises in the vicinity of the premises for which the application is sought must in accordance with Schedule 5, Paragraph 4 of the said order serve notice of their intention to object upon the Applicant at their solicitor’s address and the Clerk of Petty Sessions not less than one week before the time of the court sitting at which the application is to be made.
The permissible grounds of objection are those specified in Article 22(6) of the said order and paragraph 3 of Schedule 5 of the said order namely:-
That the proper procedure has not been complied with.
That the Applicant is not a fit person to hold a licence.
The business or the ancillary business carried on in the premises has been discontinued.
