NOTIFICATION AND PUBLICATION OF AN EIA DECISION AND REGULATORY DECISION
EIA CONSENT DECISION AND CONSENT UNDER SECTION 36 OF THE ELECTRICITY ACT 1989 (AS AMENDED)
MLA/2023/00113: WHITE CROSS OFFSHORE WIND FARM
The Marine Management Organisation (MMO) has carried out an Environmental Impact Assessment (EIA) under The Marine Works (Environmental Impact Assessment) Regulations 2007 and The Marine Works (Environmental Impact Assessment) (Amendment) Regulations 2017 (the MWRs) in relation to White Cross Floating Offshore Wind Farm, with activities to be carried out by White Cross Offshore Windfarm Limited. An EIA is also required under Regulation 3 (1) of the Electricity Works (Environmental Impact Assessment) (England and Wales) Regulations 2017 (the EWR) for Section 36 consent.
The MMO has determined that an EIA Consent Decision under the EWR is not required for the proposed regulated activity, on the basis that the assessment of the effects of the project is being carried out under the MWR.
In accordance with Regulation 22 of the MWRs, the MMO has decided to grant EIA consent for the project on 15 July 2025 subject to certain conditions being imposed.
In accordance with The Electricity Act 1989, the MMO has decided to grant Section 36 consent for the project on 15 July 2025 subject to certain conditions being imposed.

Effect of EIA Decision and Section 36 decision on the Regulatory Decision
Following the above EIA consent decision in accordance with Regulation 24 of the MWRs, the MMO has decided to grant a marine licence for White Cross Offshore Wind Farm in the Celtic Sea under the Marine and Coastal Access Act 2009 on 15 July 2025, subject to certain conditions being imposed.
