Section 252 Merchant Shipping Act 1995 and Section 32 Langstone Harbour Act 1962
Langstone Harbour Board (‘LHB’) has exercised its powers under section 252 Merchant Shipping Act 1995 in respect of the 10.4m wooden built vessel MARK TWAIN which was sunk, stranded or abandoned in the Harbour at mooring M284, in Sinah Lake (the “Vessel”).
LHB now gives 7 days’ notice of its intention to sell the Vessel and other property to which the power relates (“other property” within the scope of the power includes every article or thing or collection of things being or forming part of the equipment, cargo, stores or ballast of the vessel) to recover its expenses in relation to the exercise of its powers under section 252 of the Merchant Shipping Act 1995.
If the proceeds of sale are insufficient, LHB may also recover any short fall directly from the owner of the vessel. If there is a surplus following the sale, LHB will hold that surplus on trust for the persons entitled to it.
The owner of the vessel should contact Langstone Harbour Board (‘LHB’), using the contact details below within 7 days of the date of this notice.
