NOTICE OF MODIFICATION ORDER

WILDLIFE AND COUNTRYSIDE ACT 1981

DEFINITIVE MAP AND STATEMENT FOR THE COUNTY OF KENT

THE KENT COUNTY COUNCIL
(PUBLIC FOOTPATH CB553 AT KINGSTON AND BARHAM)
DEFINITIVE MAP MODIFICATION ORDER 2025

The above Order was made on 26 March 2025 under section 53 of the Wildlife and Countryside Act 1981. If confirmed, it will modify the Definitive Map and Statement for the area by adding a Public Footpath numbered CB553, with a width of 1.5 metres, which commences at its connection with Public Footpath CB542 at NGR TR 19835105 (point A) and runs south-east for 380 metres to its connection with Public Bridleway CB230 at NGR TR 20085077 (point E).  The path runs over the railway bridge between points B (NGR TR 19865103) and point C (NGR TR 19875103) for a length of 11 metres.  The path then runs through an area of woodland for 182 metres to NGR TR 19995089 (point D), after which it runs alongside the field boundary for 150 metres to its connection with Public Bridleway CB230 at the aforementioned point E.  As shown between points A-B-C-D-E on the Order plan.

All distances are approximate, all directions are general.

Any representation about or objection to the Order must be sent or delivered in writing to Maria McLauchlan at the Kent County Council (address as below; email as above) no later than 9 June 2025. Please state the grounds on which they are made.

Please note that objections/representations cannot be treated as confidential and may come into the public domain.  Copies of any objections or representations received may be disclosed to interested parties, including the Planning Inspectorate where the case is referred to it for determination.

If no such representations or objections are duly made to the Order (or to any part of it), or if any so made are withdrawn, the Kent County Council, instead of submitting the Order to the Secretary of State (or part of it if the Authority has by Notice to the Secretary of State so elected under paragraph 5 of schedule 15 to the Wildlife and Countryside Act 1981) may itself confirm the Order (or that part of the Order). If the Order is sent to the Secretary of State for the Environment (in whole or in part), any representations or objections which have been duly made and not been withdrawn will be sent with it.

NOTICE OF CONFIRMATION OF MODIFICATION ORDER

WILDLIFE AND COUNTRYSIDE ACT 1981

DEFINITIVE MAP AND STATEMENT FOR THE COUNTY OF KENT

DEFINITIVE MAP MODIFICATION ORDER 2025

On 26 March 2025 the Kent County Council confirmed the above Order without modifications.

The effect of the Order as confirmed is to modify the Definitive Map and Statement for the area by adding a public footpath numbered MR624, which commences on Westwood Road at NGR TQ 6644 4878 (point A) and runs north north-west for 41 metres to NGR TQ 6642 4882 (point B), then north north-west for 28 metres to NGR TQ 6641 4884 (point C); it then runs north for 21 metres, then north-west for approximately 29 metres, and then west for approximately 7 metres to its connection with Drage Road at NGR TQ 6638 4888 (point D), as shown between the points A-B-C-D on the Order plan.

The path has a width of 2.7 metres between NGR TQ 6644 4878 (point A) and NGR TQ 6641 4884 (point C), and a width of 2.0 metres between NGR TQ 6641 4884 (point C) and NGR TQ 6638 4888 (point D).

This Order became operative as from 26 March 2025 but if a person aggrieved by the Order desires to question the validity thereof or of any provision contained therein on the grounds that it is not within the powers of Section 53(3)(c)(i) of the Wildlife and Countryside Act 1981, or that any of the requirements of Schedule 15 to the Act have not been complied with in relation to the confirmation of the Order, they may, under Paragraph 12 of Schedule 15 to the Act, within 42 days from 25 April 2025 make application for the purpose to the High Court.

Notice of extension of an Order temporarily closing WT327 and WT328 in the Parish of Horsmonden

(Prohibition Of Traffic) Temporary Order 2024

Road Traffic Regulation Act 1984 Section 14(1), As Amended By The Road Traffic (Temporary Restrictions) Act 1991

The Secretary of State for Transport has directed that the Order made by Kent County Council on the 05 November 2024, the effect of which was to prohibit all traffic from Public Footpaths WT327 and WT328 has been extended for a further 12 months, until the 05 May 2026 or until the completion of the works, whichever is the earlier

Public Footpath WT327 is closed from Maidstone Road for a distance of 500 metres, and Public Footpath WT328 from NGR TQ 706 444 to NGR TQ 705 439.

The alternative route for WT327 is around the northern field boundary.

There is no alternative route available for WT328.

Both routes will be signed for the duration of the closure.
