NOTICE OF INTENTION TO DEMOLISH DWELLING HOUSES
Kingston upon Hull City Council (“the Landlord”) hereby gives Notice that it intends to demolish the following dwelling houses (“the Relevant Premises”):
1, 2, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 27, 29, 30, 31 and 33 Rossett House
The reasons the Landlord intends to demolish the relevant premises are:
• Evaluations have been carried out considering both refurbishment and demolition options. Demolition is the most viable option for the Relevant Premises following assessment of the current condition and the need for extensive capital investment to meet various health and safety compliance standards.
• The current condition of the building presents ongoing difficulties, and future projections highlight the need for modernisation to support the Council’s long term asset management plans and ensure responsible financial management of the Housing Revenue Account.
• The demolition and redevelopment of the relevant premises can provide properties on the site which are more efficient, built to modern standards and designed to modern neighbourhood design principles. The removal of unsustainable housing stock contributes to strategic housing, health and wellbeing objectives.
• The results of the consultation showed residents favoured demolition over refurbishment.
The landlord intends to demolish the Relevant Premises within seven years of 24th March 2025.
The Initial Demolition Notice in respect of any dwelling house contained in the Relevant Premises will cease to be in force seven years from 8th April 2025 revoked or terminated in accordance with Schedule 5A paragraph 3 of the Housing Act 1985.
Whilst an Initial Demolition Notice in respect of a dwelling house contained in the Relevant Premises is in force, the Landlord will not be under any obligation to make such a grant as is mentioned in Section 138(1) Housing Act 1985 in respect of any claim made by the tenant to exercise the right to buy in respect of a dwelling house contained in the Relevant Premises.
There may be a right to compensation under Section 138C of the Housing Act 1985 in respect of certain expenditure incurred in respect of any claim made by a tenant to exercise the right to buy in respect of any dwelling house contained in the Relevant Premises which is in existence on 8th April 2025.
