NOTICE OF APPLICATION FOR THE

TRANSFER OF A LICENCE

PETTY SESSIONS DISTRICT OF ARDS

COUNTRY COURT DIVISION OF NORTHERN IRELAND

TAKE NOTICE that we, Smoke BBQ Ltd (NI714258), having its registered office situate at 37 Movilla Street, Newtownards, Northern Ireland, BT23 7JQ, intend at the Magistrates Court sitting at Newtownards Courthouse, Regent Street, Newtownards, BT23 4LP on the 1st day of May 2025 at 10.30 a.m. to apply for a Transfer to us of a Licence at present held by Belfast International Water Sports of 12-14 Cornmarket, Belfast, BT1 4DD for the premises at Lets Go Hydro, 591 Saintfield Road, 1 Mealough Road, Carryduff, BT8 8BP/BT8 8GB being premises of the following kind according to the Licensing (Northern Ireland) Order 1996 namely premises specified in Article 5(1) (e) (other than those referred to in Article 5(1)(a) of the Order) structurally adapted and used, or intended to be used, for the purpose of providing persons frequenting the premises with a main table meal at midday or in the evening, or both.



The applicant company is a private limited company and the owner of the business to be carried on under the licence. The sole director is Daryl Patterson of 5 Abbot Park, Newtownards, Co. Down, BT23 8XP.



The owner of the premises is Belfast International Water Sports Limited (NI643375) whose registered office is situate at 7-19 Royal Avenue, Belfast BT1 1FB.



The applicant currently holds the licence by way of a Protection Order granted on 5th November 2024. The licence will be deposited with the Clerk of Petty Sessions before or at the hearing of the application.



AND FURTHER TAKE NOTICE that any person owning or residing or carrying on business in premises in the vicinity of the premises for which the application is sought must in accordance with Schedule 5, Paragraph 4 of the said order serve notice of their intention to object upon

the Applicant at their solicitor’s address and the Clerk of Petty Sessions not less than one week before the time of the court sitting at which the application is to be made.





The permissible grounds of objection are those specified in Article 22(6) of the said order and paragraph 3 of Schedule 5 of the said order namely:-





That the proper procedure has not been complied with.

That the Applicant is not a fit person to hold a licence.

The business or the ancillary business carried on in the premises has been discontinued.
