SECTION 56 PLANNING ACT 2008
REGULATION 9 OF THE INFRASTRUCTURE PLANNING (APPLICATIONS: PRESCRIBED FORMS AND PROCEDURE) REGULATIONS 2009
REGULATION 16 OF THE INFRASTRUCTURE PLANNING (ENVIRONMENTAL IMPACT ASSESSMENT) REGULATIONS 2017
NOTICE OF ACCEPTANCE OF AN APPLICATION FOR AN ORDER GRANTING DEVELOPMENT CONSENT UNDER SECTION 56 OF THE PLANNING ACT 2008
FENWICK SOLAR FARM
PLANNING INSPECTORATE REFERENCE: EN010152

Notice is hereby given that the Secretary of State has accepted an application (Reference No. EN010152) by Fenwick Solar Project Limited (company number 13705886) of Unit 5E, Park Farm, Arundel, BN18 0AG (“the Applicant”) for a Development Consent Order (“DCO”) under the Planning Act 2008 (“the Application”). The Application was received by the Planning Inspectorate on 1 November 2024 and accepted for examination on 29 November 2024.
Fenwick Solar Farm
Fenwick Solar Farm (“the Scheme”) comprises the construction, operation and maintenance, and decommissioning of a solar photovoltaic (“PV”) electricity generating facility and associated development. The associated development includes, but is not limited to, a Battery Energy Storage System, On-Site Substation, underground cabling to provide export and import connection to the National Electricity Transmission System (“NETS”), and areas of landscaping and biodiversity enhancements.
The connection to the NETS will be either via underground cabling along a corridor in which three 400 kV cables would run for approximately 6.3 km from the Solar PV Site to the Existing National Grid Thorpe Marsh Substation; or via underground cabling between the On-Site Substation and existing overhead power lines within the Solar PV Site, which also connect to the Existing National Thorpe Marsh Substation.
The Scheme is located entirely within the City of Doncaster Council’s administrative area and located on land close to the villages of Fenwick, Moss and Sykehouse, as well as the Hamlet of Topham. The northern edge of the Solar PV Site borders the River Went, within the administrative area of City of Doncaster Council. A map showing the location of the Scheme can be viewed on the National Infrastructure Planning website at the following link:
https://national-infrastructure-consenting.planninginspectorate.gov.uk/projects/EN010152
Development consent is required to the extent that development is or forms part of a Nationally Significant Infrastructure Project (“NSIP”) pursuant to sections 14(1)(a), 15(1) and 15(2) of the Planning Act 2008, as an onshore generating station located in England with a capacity exceeding 50 MW. It is for this reason that the Scheme falls within the remit of the Secretary of State’s decision-making powers.
The DCO, if granted, would authorise the compulsory acquisition of land, interests in land and rights over land, and the powers to use land permanently and temporarily. The DCO would also authorise alterations to the layout of streets, the construction of accesses to the Scheme, the diversion of public rights of way, street works, removal of hedgerows, and the application and disapplication of legislation.
Environmental Impact Assessment
The Scheme is an Environmental Impact Assessment (“EIA”) development, as defined by the Infrastructure Planning (Environmental Impact Assessment) Regulations 2017 and, accordingly, an Environmental Statement accompanies the Application.
Application documents
The Application form and its accompanying documents, plans and maps, Environmental Statement and Non-Technical Summary, and the draft DCO, are available to view electronically and download, free of charge, under the “Documents” tab on the Fenwick Solar Farm project page of the Planning Inspectorate’s website, being a website maintained by or on behalf of the Secretary of State:
https://national-infrastructure-consenting.planninginspectorate.gov.uk/projects/EN010152
These documents will be available to view on the Planning Inspectorate’s website at least until the Secretary of State makes their decision whether or not to grant the Development Consent Order.
On request, an electronic copy of the Application documents can be supplied free of charge on a USB memory stick. Contact details to request the USB can be found at the end of this notice.
