DEFINITIVE MAP AND STATEMENT FOR THE COUNTY OF KENT

THE KENT COUNTY COUNCIL
(PUBLIC FOOTPATH EE500 AT EASTRY AND WOODNESBOROUGH)
DEFINITIVE MAP MODIFICATION ORDER 2024

The above Order was made on 20 November 2024 under section 53 of the Wildlife and Countryside Act 1981. If confirmed, it will modify the Definitive Map and Statement for the area by adding a footpath with a width of 1.5 metres which commences on Chalkpit Lane by Hammill Farm at NGR TR 2909 5546 (Point A) and runs in an east southeasterly direction for 252 metres to NGR TR 2931 5534 (Point B), then continues in an easterly direction for 725 metres to NGR TR 3003 5520 (Point C), then continues in a southeasterly direction for 105 metres to NGR TR 3011 5514 (Point D), then continues in an easterly direction for 249 metres to NGR TR 3036 5512 (Point E), then continues in a southeasterly direction for 234 metres to its connection with Gore Lane at NGR TR 3056 5500 (Point F). As shown on the Order plan between the points A-B-C-D-E-F.

Any representation about or objection to the Order must be sent or delivered in writing to Michael Tonkin at the Kent County Council (address as below) no later than 10 January 2025. Please state the grounds on which they are made.

Please note that objections/representations cannot be treated as confidential and may come into the public domain. Copies of any objections or representations received may be disclosed to interested parties, including the Planning Inspectorate where the case is referred to it for determination.

If no such representations or objections are duly made to the Order (or to any part of it), or if any so made are withdrawn, the Kent County Council, instead of submitting the Order to the Secretary of State (or part of it if the Authority has by Notice to the Secretary of State so elected under paragraph 5 of schedule 15 to the Wildlife and Countryside Act 1981) may itself confirm the Order (or that part of the Order). If the Order is sent to the Secretary of State for the Environment (in whole or in part), any representations or objections which have been duly made and not been withdrawn will be sent with it.

PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2024

On 13 November 2024 the Kent County Council confirmed the above Order under Section 119 of the Highways Act 1980.

The effect of that Order as confirmed is to divert the entire width of that length of footpath numbered KH147, which commences on Pilgrims Way at NGR TQ 8281 5697 (point A) and runs north-east for 382 metres to its connection with public footpath KH191 at NGR TQ 8309 5723 (point B), as shown between the points A-B on the Order plan, and to provide a new length of footpath numbered KH147, with a width of 2.0 metres, which commences at the aforementioned point A and runs east for 35 metres to NGR TQ 8285 5696 (point C), then north-east for 364 metres to NGR TQ 8313 5719 (point D), and then north-west for 61 metres to the aforementioned point B, as shown between the points A-C-D-B on the Order plan.

The Order comes into force on 11 December 2024, but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 (the Act), as amended, and/or the powers of section 53A of the Wildlife and Countryside Act 1981 (WCA) or on the ground that any requirement of either Act or of any regulation made under them has not been complied with in relation to the Order, he or she may under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, and as applied by s53A(7) WCA, within 6 weeks from the 29 November 2024, make an application to the High Court.

On 13 November 2024 the Kent County Council confirmed the above Order under Section 119 of the Highways Act 1980.

The effect of that Order as confirmed is to divert the entire width of that length of footpath numbered KH147A, which commences on an unaffected length of public footpath KH147A at NGR TQ 8277 5710 (point A) and runs north north-west, north, north north-west, north-west and north north-west for 687 metres to its connection with Byway Open to All Traffic KH167 at NGR TQ 8252 5772 (point B), between the points A-B on the Order plan, and to provide a new length of public footpath numbered KH147A, with a width of 2.0 metres, which commences at the aforementioned point A and runs north north-west for 474 metres to its connection with public footpath KH190 at NGR TQ 8263 5755, then north-west for 123 metres to its connection with Byway Open to All Traffic KH167 at NGR TQ 8254 5763 (point C), between the points A-C on the Order plan.

Notice of extension of an Order temporarily closing Public Footpath MR251 in the Parish of Borough Green

Road Traffic Regulation Act 1984 Section 14(1), As Amended By The Road Traffic (Temporary Restrictions) Act 1991

The Secretary of State for Transport has directed that the Order made by Kent County Council on the 28 May 2021, and subsequently extended until 4 December 2024, the effect of which was to prohibit all traffic from Public Footpath MR251 has been extended for a further 12 months, until the 4 December 2025 or until the completion of the works, whichever is the earlier.

The path is closed between NGR TQ 614579 and its junction with Public Footpath MR252.

The alternative route is adjacent to the existing path and will be signed for the duration of the closure.

PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2024

On 15 November 2024 The Kent County Council confirmed the above Order under Section 119 of the Highways Act 1980.

The effect of that Order as confirmed is to divert that length of public footpath numbered WC16, which commences at its junction with public footpath WC19 at NGR TQ 7324 3914 (Point A) and travels in a southeasterly direction for 291 metres to NGR TQ 7348 3899 (Point B) where an unaffected length for WC16 continues. As shown by the bold black line between Points A-B on the Order Plan, and to provide a new length of public footpath numbered WC16 with a width of 2.0 metres, which commences on a new connection point with public footpath WC19 at NGR TQ 7322 3909 (Point C) and travels in an east southeasterly direction for 85 metres to NGR TQ 7330 3905 (Point D), before continuing in a north northeasterly direction for 36 metres to NGR TQ 7331 3908 (Point E), then continues in a southeasterly direction for 189 metres to NGR TQ 7348 3900 (Point F), then continues in a southerly direction for 15 metres to the aforementioned Point B, where an unaffected length of WC16 continues. As shown by the bold broken line between Points C-D-E-F-B on the Order Plan.

Notice of extension of an Order temporarily closing Public Footpaths WC94 and WC95 in the Parish of Cranbrook

Road Traffic Regulation Act 1984 Section 14(1), As Amended By The Road Traffic (Temporary Restrictions) Act 1991

The Secretary of State for Transport has directed that the Order made by Kent County Council on the 10 November 2023, and subsequently extended until 10 December 2024, the effect of which was to prohibit all traffic from Public Footpaths WC94 and WC95 has been extended for a further 6 months, until the 10 June 2025 or until the completion of the works, whichever is the earlier.

Public Footpath WC94 is closed from the junction with Public Footpath WC95 for a distance of 90m, and Public Footpath WC95 is closed between Public Footpath WC96 and the High Street.

The alternative route is along the southern boundary of the development site and will be signed for the duration of the closure.
