Notice of the intention to make an Order to temporarily close Public Footpaths CH2 and CH4 in the Parish of Sturry

In The City of Canterbury

(Prohibition Of Traffic) Temporary Order 2024

Road Traffic Regulation Act 1984, Section 14(1), As Amended By The Road Traffic (Temporary Restrictions) Act 1991

Kent County Council intends to make an Order the effect of which is to temporarily close Public Footpath CH2 165m southeast of its junction with Public Footpath CH67 for approximately 100m and to close Public Footpath CH4 from its junction with Public Footpath CH67 for approximately 250m from the 16 September 2024.

The paths will be closed for a maximum of six months, although it is expected that they will reopen 20 December 2024.

The paths are to be closed because works are planned on or near them.

The alternative route will be signed for the duration of the closure.

PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2021

Notice is hereby given that on the 14th August 2024, the Kent County Council certified that the terms of Article 2 of the above-named Order, requiring an alternative highway to be created to the reasonable satisfaction of the Kent County Council, has been complied with.

Accordingly, the above-named Order has now taken effect.

Kent County Council has made an Order the effect of which is to temporarily close Public Footpath NU5 between Crete Hall Road and Old Sun Wharf from the 23 August 2024

The path will be closed for a maximum of six months.

The path is closed because works are planned on or near it.

The alternative route is via Crete Hall Road and will be signed for the duration of the closure.

NOTICE OF PUBLIC PATH ORDER

HIGHWAYS ACT 1980
WILDLIFE AND COUNTRYSIDE ACT 1981

THE KENT COUNTY COUNCIL
(PUBLIC FOOTPATHS KM20 (part) and KM21 (part), WEST FARLEIGH)
PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2024

The above-named Order made on 9 August 2024 under Section 119 of the Highways Act 1980 will divert:

1) the entire width of that length of public footpath numbered KM20, which commences on an unaffected length of public footpath KM20 at NGR TQ 7159 5330 (point A), and runs west for 221 metres to its connection with public footpath KM21 at NGR TQ 7137 5332 (point B), as shown by a bold continuous line between the points A-B on the Order plan;

AND

2) the entire width of that length of public footpath numbered KM21, which commences at the aforementioned point B and runs west south-west for 147 metres to its connection with an unaffected length of public footpath KM21 at NGR TQ 7123 5328 (point C), as shown by a bold continuous line between the points B-C on the Order plan.

The above-named Order will add:

1) a new length of public footpath numbered KM20, with a width of 2.0 metres, which commences at the aforementioned point A and runs west for approximately 223 metres to its connection with the aforementioned point B, as shown by a bold broken line between the points A-B on the Order plan;

AND

2) a new length of public footpath numbered KM21, with a width of 2.0 metres, which commences at the aforementioned point B and runs south-west for 135 metres to NGR TQ 7127 5324 (point D), and then north-west for 58 metres the aforementioned point C, as shown by a bold broken line between the points B-C on the Order plan.

All directions general, all distances approximate.

Please note that objections/representations cannot be treated as confidential and may come into the public domain.  Copies of any objections or representations received may be disclosed to interested parties, including the Planning Inspectorate where the case is referred to it for determination.

If no such representations or objections are duly made, or if any so made are withdrawn, the Kent County Council may confirm the Order as an unopposed Order.  If the Order is sent to the Secretary of State for the Environment for confirmation any representations and objections which have not been withdrawn will be sent with the Order.

(PUBLIC FOOTPATH KM43 (PART), EAST FARLEIGH) PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2022

(2) THE KENT COUNTY COUNCIL
(PUBLIC FOOTPATH KM42 (PART) EAST FARLEIGH) PUBLIC PATH EXTINGUISHMENT AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2022

On the 23rd July 2024, the Secretary of State for the Department for Environment, Food and Rural Affairs confirmed with modifications

(1) The above-named diversion Order under Section 119 of the Highways Act 1980, the effect of that Order as confirmed is to divert the entire width of that length of public footpath numbered KM43 which commences at NGR TQ 7400 5169 (Point A) and runs in a north through to north-north east direction for 340 metres to NGR TQ 7409 5202 (Point B). As shown by a solid black line between Points A-B on the Order plan and will add a new length of public footpath numbered KM43 with a width of 2.5 metres which (a) commences at the aforementioned Point A and runs in a north-northeasterly direction for 125 metres to NGR TQ 7404 5181 (Point C), continuing in an east-south- easterly direction for 47 metres to NGR TQ 7409 5180 (Point D), before continuing via a curve in a north-easterly direction for 16 metres to NGR TQ 7410 5180 (Point E), continuing in a north-north-easterly direction for 129 metres to NGR TQ 7415 5192 (Point F), and then a northerly direction for 22 metres to NGR TQ 7415 5195 and then in a north-westerly direction for 98 metres to NGR TQ 7408 5201 (Point G), before continuing in a north-easterly direction for 12 metres to the aforementioned Point B and (b) commences at the aforementioned Point F and runs in a south-easterly direction for 1.5 metres to Public Footpath KM42 at NGR TQ 7415 5192 (Point H). As shown by a broken black line on the Order plan.

(2) The above-named extinguishment order under Section 118 of the Highways Act 1980 the effect of that Order as confirmed is to extinguish the entire width of that length of Public Footpath KM42 which commences at NGR TQ 7415 5192 (Point K) and runs in a northerly direction for 22 metres to NGR TQ 7415 5195 and then in a north-westerly direction for 63 metres to NGR TQ 7411 5199 and continues in a north-north-westerly direction for 32 metres to NGR TQ 7410 5202 (Point J). As shown by the solid black line on the order plan.

The Orders come into force on the 17th September 2024 but if a person aggrieved by the Orders wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 (the Act), as amended, and/or the powers of section 53A of the Wildlife and Countryside Act 1981 (WCA) or on the ground that any requirement of either Act or of any regulation made under them has not been complied with in relation to the Orders, he or she may under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, and as applied by s53A(7) WCA, within 6 weeks from the 23rd August 2024, make an application to the High Court.

Kent County Council intends to make an Order the effect of which is to temporarily close Public Footpath KM86 between the junction of Public Footpath KM80 and The Beams from 16 September 2024

The path will be closed for a maximum of six months, although it is expected that it will reopen 14 October 2024

The path is to be closed because works are planned on or near it.

NOTICE OF MODIFICATION ORDER

WILDLIFE AND COUNTRYSIDE ACT 1981

DEFINITIVE MAP AND STATEMENT FOR THE COUNTY OF KENT

THE KENT COUNTY COUNCIL(FOOTPATH SR535 (part) AT CHIDDINGSTONE)
DEFINITIVE MAP MODIFICATION ORDER 2024

The above Order was made on 9 August 2024 under section 53 of the Wildlife and Countryside Act 1981. If confirmed, it will modify the Definitive Map and Statement for the area by deleting that part of public footpath numbered SR535, which commences on the C306 (Truggers Lane to Grove Road) at NGR TQ 49609 42506 (point A) and runs north for 50 metres to its connection with an unaffected length of public footpath SR535 at NGR TQ 4961 4255 (point B), as shown between the points A-B on the Order plan, and by adding a public footpath numbered SR535, with a width of 1.5 metres, which commences at the aforementioned point B and runs south south-east for 34 metres and then south for 16 metres to its connection with the C306 (Truggers Lane to Grove Road) at NGR TQ 49606 42506 (point C), 2.8 metres west of the aforementioned point A, as shown between the points B-C on the Order plan.

Kent County Council intends to make an Order the effect of which is to temporarily close Public Footpath ZR117 between Chestnut Street and Public Footpath ZR118 from the 07 September 2024

The path will be closed for a maximum of six months, and it is expected that this period will be extended.

The path is to be closed because works are planned on or near it.

The alternative route is via Chestnut Street and School Lane, and will be signed for the duration of the closure.
