Mae'r Ymchwiliad Rhithwir yn cael ei gynnal ynglyn a'r apel gan MS CAROLINE PLATT yn erbyn methiant gan y Rheoleiddiwr i roi hysbysiad o benderfyniad ynglyn a chais ar gyfer trwydded amgylcheddol, amrywiad, trosglwyddiad neu ildiad o fewn y cyfnod statudol ('gwrthodiad tybiedig'). Rhoddir manylion ychwanegol isod. Bydd yr Arolygydd yn clywed tystiolaeth gan y partion i'r apel ac, yn 61 ei ddisgresiwn, yn clywed sylwadau gan unrhyw unigolyn arall a allai ddymuno ymddangos a chael ei glywed. Mae'r apel yn erbyn gwrthodiad 'tybiedig' cais ar gyfer trwydded amgylcheddol i awdurdodi gweithrediadau gwastraff a derbyn, storio ac adfer hyd at 60,000 o dunelli y flwyddyn o wastraff pren gweithgynhyrchu nad yw'n beryglus. Roedd y gweithgareddau arfaethedig yn cynnwys:

* Storio a thrin gwastraff pren glan, heb ei drin i gynhyrchu deunydd gorwedd ar gyfer anifeiliaid. Mae'r driniaeth wedi'i chyfyngu i falurio a chael gwared ar Iwch pren.

* Storio a thrin gwastraff pren wedi'i drin i gynhyrchu cyflyrydd ciwbiclau i'w ddefnyddio yn y diwydiant da byw amaethyddol. Mae'r driniaeth wedi'i chyfyngu i falurio er mwyn cynhyrchu llwch pren.

Ni phenderfynwyd ar y cais erbyn y terfyn amser statudol ac mae'r Cwmni wedi cyflwyno apel i Weinidogion Cymru gan ofyn iddynt gyfarwyddo'r Rheoleiddiwr i ganiatau trwydded i'r cwmni.

THE ENVIRONMENTAL PERMITTING (ENGLAND AND WALES) REGULATIONS 2016

NOTICE IS HEREBY GIVEN THAT AN INSPECTOR APPOINTED BY

THE WELSH MINISTERS UNDER SECTION 114 OF THE ENVIRONMENT ACT 1995 TO DETERMINE THE APPEAL

WILL HOLD A VIRTUAL INQUIRY1

ON

MONDAY, 24th JUNE 2024 at 10.00 a.m.

The Virtual Inquiry is being held into the appeal by MS CAROLINE PLATT against a failure by the Regulator to give notice of determination of application for an environmental permit, variation, transfer or surrender within statutory time-period ('deemed refusal'). Further details are given below. The Inspector will hear evidence from the parties to the appeal and, at the Inspectors discretion, hear representations from any other person who may wish to appear and be heard. The inquiry is expected to sit for 5 days.

If actively participating, please state your preference of Welsh or English. Instructions on how to join the event will be sent under separate cover.

The appeal is against the 'deemed' refusal of an application for an environmental permit to authorise waste operations and the receipt, storage and recovery of up to 60,000 tonnes of non-hazardous manufacturing wood waste per annum.

The proposed activities included:

* Storage and treatment of clean, untreated wood waste to produce animal bedding material. Treatment limited to pulverising and removal of wood dust.

* Storage and treatment of treated wood waste to produce cubicle conditioner to be used in the agricultural livestock industry. Treatment limited to pulverising to produce wood dust.

The application was not determined by the statutory deadline and the Company has appealed to the Welsh Ministers requesting that the Regulator be directed to grant the company a permit.
