Hysbysir drwy hyn fod Gweinidogion Llywodraeth Cymru, wrth arfer eu pwerau o dan y Deddfau uchod, ar y deunawfed o Ebrill Dwy Fil a Dau Ddeg Pedwar, wedi cadarnhau gydag addasiadau Orchymyn Prynu Gorfodol (Ffordd Gyswllt Gorllewin Caerfyrddin) Cyngor Sir Caerfyrddin 2023 a gyflwynwyd gan Gyngor Sir Caerfyrddin (“y gorchymyn”) 2. Mae’r Gorchymyn yn darparu ar gyfer prynu’r tir a’r hawliau newydd dros y tir a ddisgrifir yn Atodlen 1 isod at ddibenion:

(a) Hwyluso’r datblygiad tir drwy adeiladu llwybr cyd-ddefnyddio sy’n addas i gynnwys cerddwyr a beicwyr a fydd yn ymestyn i gyfeiriad y gorllewin o Ffair-fach, Llandeilo i Felin-wen, pellter o ryw bedwar ar bymtheg pwynt degol dau dau (19.22) cilomedr, a fydd unwaith y caiff ei adeiladu yn cyfrannu at hyrwyddo a gwella llesiant economaidd, cymdeithasol ac amgylcheddol yr ardal.

3. Mae copïau o’r gorchymyn ac o’r map y cyfeirir ato yn y gorchymyn wedi’u gadael yn Hwb Gwasanaethau Cwsmeriaid Cyngor Sir Caerfyrddin yn Uned 22, Rhodfa’r Santes Catrin, Caerfyrddin, SA31 1GA ac yn Llyfrgell Caerfyrddin, Heol San Pedr, Caerfyrddin, SA31 1LN a gellir eu harchwilio yn rhad ac am ddim yn ystod oriau swyddfa arferol a hefyd yn Llyfrgell Llandeilo, Heol Cilgant, Llandeilo, SA19 6HN (Sylwer: mae Llyfrgell Llandeilo ar gau ar ddydd Llun a dydd Iau). Gellir gweld y gorchymyn a’r map ar wefan Cyngor Sir Caerfyrddin hefyd.

4. Daw’r gorchymyn i rym ar ddyddiad cyntaf cyhoeddi’r Hysbysiad hwn. Gall person y mae’r Gorchymyn yn ei dramgwyddo herio ei ddilysrwydd o dan adran 23 o Ddeddf Caffael Tir 1981 trwy wneud cais i’r Uchel Lys o fewn chwe (6) wythnos i’r dyddiad hwnnw. Y sail dros herio yw nad yw’r awdurdodiad a roddwyd gan y gorchymyn wedi’i rymuso i gael ei roi neu fod methiant wedi bod i gydymffurfio ag unrhyw ofyniad statudol perthnasol sy’n ymwneud â’r gorchymyn.

5. Pan fo’r Gorchymyn yn weithredol gall Cyngor Sir Caerfyrddin gaffael unrhyw dir a ddisgrifir yn Atodlen 1 isod drwy wneud datganiad breinio cyffredinol o dan adran 4 o Ddeddf Prynu Gorfodol (Datganiadau Breinio) 1981. Nodir datganiad ar effaith Rhannau 2 a 3 o’r Ddeddf honno yn Atodlen 2 isod.

6. Gwahoddir pawb a fyddai â hawl i iawndal ar gyfer unrhyw dir o’r fath o dan adran 4 o’r Ddeddf Prynu Gorfodol (Datganiadau Breinio) 1981, petai datganiad breinio cyffredinol yn cael ei wneud ynghylch y tir a nodir yn y gorchymyn (ac eithrio tir y rhoddwyd hysbysiad i drafod telerau yn ei gylch), i roi gwybodaeth i Gyngor Sir Caerfyrddin yn Neuadd y Sir, Caerfyrddin SA31 1JP ar y ffurflen benodedig o ran enw a chyfeiriad y person a’r tir dan sylw. Mae’r ffurflen honno a bennir i’w gweld yn Atodlen 3 isod.

The Carmarthenshire County Council (Ffairfach to Whitemill Shared Use Route) Compulsory Purchase Order 2023 The Town and Country Planning Act 1990 Local Government (Miscellaneous Provisions) Act 1976 and The Acquisition of Land Act 1981

Compulsory Purchase of Land and New Rights Between Whitemill and Ffairfach Carmarthenshire

1. Notice is hereby given that the Welsh Ministers in exercise of their powers under the above Acts, on the eighteenth day of April Two Thousand and Twenty Four confirmed with modifications The Carmarthenshire County Council (Carmarthen Western Link Road) Compulsory Purchase Order 2023 submitted by the Carmarthenshire County Council (“the order”).

2. The order provides for the purchase of the land and the new rights over land described in Schedule 1 below for the purposes of: (a) Facilitating the development of land by the construction of a shared use route suitable to accommodate both pedestrians and cyclists which will extend in a westerly direction from Ffairfach, Llandeilo to Whitemill, a distance of approximately nineteen decimal point two two (19.22) kilometres, which route once constructed will contribute to the achievement of the promotion and improvement of the economic, social and environmental well-being of its area.

3. A copy of the order and of the map referred to in the order have been deposited at Carmarthenshire County Council’s Customer Service Hwb at Unit 22 St. Catherine’s Walk, Carmarthen SA31 1GA and at The Carmarthen Library at St Peter’s Street Carmarthen SA31 1LN and may be inspected free of charge during normal office hours and also at Llandeilo Library Crescent Road, Llandeilo, SA19 6HN (N.B. Llandeilo Library is closed Monday and Thursday). The order and map may also be viewed on Carmarthenshire County Council’s website.

4. The order becomes operative on the date on which this notice is first published. A person aggrieved by the order may, by application to the High Court within six (6) weeks from that date, challenge its validity under section 23 of the Acquisition of Land Act 1981. The grounds for challenge are that the authorisation granted by the order is not empowered to be granted or that there has been a failure to comply with any relevant statutory requirement relating to the order.

5. Once the order has become operative, Carmarthenshire County Council may acquire any of the land described in Schedule 1 below by executing a general vesting declaration under section 4 of the Compulsory Purchase (Vesting Declarations) Act 1981. A statement on the effect of Parts 2 and 3 of that Act is set out in Schedule 2 below.

6. Every person who, if a general vesting declaration were executed under section 4 of the Compulsory Purchase (Vesting Declarations) Act 1981 in respect of the land comprised in the order (other than land in respect of which notice to treat has been given), would be entitled to claim compensation in respect of any such land, is invited to give information to the Carmarthenshire County Council at County Hall Carmarthen SA31 1JP as to the person’s name and address and the land in question, using a prescribed form. The relevant prescribed form is set out in Schedule 3 below.

The right to enter with all necessary workmen vehicles machinery plant and apparatus over 13 square metres of land comprising of river embankment and bed of the river Annell situated to the south of the property known as Whitemill Farm for the purpose of surveying constructing and installing a bridge extending over the airspace thereof together with associated structures to accommodate a highway comprising of a shared use pedestrian/cycle route including the right thereafter to enter as aforesaid for the purpose of reconstructing reinstalling inspecting altering renewing repairing maintaining or removing the same and furthermore the right for pedestrians, cyclists and maintenance vehicles to pass over and along the bridge to access such parts of the route that extend beyond this plot.
