PROPOSAL FOR A CONSOLIDATED SMOKE CONTROL
ORDER TO BE MADE UNDER SECTION 18 OF THE CLEAN
AIR ACT 1993
1. Notice is hereby given that the London Borough of
Hammersmith and Fulham (“the Council”) of Hammersmith
& Fulham Council, Town Hall, King Street, Hammersmith,
London, W6 9JU proposes to make an Order, in the exercise
of its powers under Section 18 of the Clean Air Act 1993
(“the Act”) to revoke previous Smoke Control Orders as
listed in the Schedule 2 in so far as they apply to the area
of the London Borough of Hammersmith and Fulham and to
declare its area to be a Smoke Control Area.
2. The proposed Order entitled the London Borough of
Hammersmith and Fulham Smoke Control Order 2024 would
come into operation on the 7th of October 2024.
3. The area covered by the proposed Order is the whole of the
London Borough of Hammersmith and Fulham.
4. The proposed Order will take effect if confirmed by the
Secretary of State.
5. If, on any day after the proposed Order comes into operation,
smoke is emitted from a chimney of any building or vessel
within the area covered by the Order, the occupier of that
building or vessel will be guilty of an offence and liable to a
fine of between £175 and £300, subject to any objection on
the grounds specified by Section 19A of, and Schedule 1A
to the Act.
6. If, on any day after the proposed Order comes into operation,
any person acquires for use in a fireplace/stove other
than an approved appliance, or sells by retail for delivery,
unauthorised fuel within the area covered by the Order,
they will be guilty of an offence and liable to a fine, unless,
in the case of an offence consisting of the sale of unauthorised
fuel for delivery, they prove they believed and had reasonable
grounds for believing that the fuel was acquired for use in an
exempt appliance.
7. The proposed Order will revoke all the Smoke Control Orders
listed in Schedule 2 in so far as they apply to the area of the
London Borough of Hammersmith and Fulham in order to
consolidate them into one Smoke Control Order covering the
whole of the area of the Council. The Smoke Control Orders
listed in Schedule 2 shall remain in full force and effect in so
far as they apply to buildings outside of the Council’s area,
following changes to the local authority boundaries.
8. Copies of the proposed Order and accompanying plan may
be inspected free of charge at the four following council
libraries during normal opening hours from Wednesday
13th December 2023 to Wednesday 7th February 2024:

9. Within this period (13th December 2023 to 7th February 2024),
any person who will be affected by the proposed
Order may object to the revocation of the previous
Smoke Control Orders listed below in Schedule 2 by
the 7th of February 2024 by giving notice by email to
Air.Quality@defra.gov.uk

All objections should be clearly headed ‘Objection to revision to
Smoke Control Orders in the London Borough of Hammersmith
and Fulham’.

borough wide Smoke Control Order 2024 may object by
