Proposed deregistration of common land/town or village green at: Brow Moor Common, Registration Number: CL.1

Dennis Gillson and Sone Ltd. has applied to the Secretary of State for Environment, Food and Rural Affairs under section 16 of the Commons Act 2006 for land forming part of the above-mentioned registered common land (the "release land") to cease to be so registered. The Planning Inspectorate will decide the application on behalf of the Secretary of State.

The purpose of this application is to enable a small extension to the quarry, as approved under Planning Permission ref: 18/03635/MAF, with an area of approximately 1.25ha of Brow Moor. The extension area occupies just 2.75% of the existing Common Land. The extension area would be fenced off for health and safety reasons, and to prevent unauthorised access to the working quarry. The works will cease not later than 2042, and the quarry will be restored with the aim of enhancing biodiversity and habitats for flora and fauna, and improving landscape impact. The proposed deregistration of the release land would not affect the route of any public footpath. Additionally, as the release land does not have any boundary treatment, existing commoners right to pasture cannot be exercised and, therefore, the proposed deregistration of the release land would not affect any right to pasture on Brow Moor Common. Fencing will remain at the top of retained quarry faces.

It is proposed that land (the "replacement land") be registered as common land in place of the release land. The replacement land is more than twice the size of the release land and is located some 2000m (or a 3-minute drive) to the south of the release land. The replacement land benefits from structurally sound dry-stone walling on all of its boundaries and is accessed by a steel gate off the public highway. Consequently, any commoners' rights involving livestock could be exercised on the Replacement land, whereas they cannot currently be exercised on the Release land. Two gates are proposed to be installed at the boundary of the replacement land to facilitate public access, one on the north western boundary and one on the southern boundary.

FIRST SCHEDULE (The release land)

The release land is located some 500m to the southeast of the village of Haworth, in the southwest corner of Brow Moor Common (ref: CL.1), centred around the grid reference: SE 04203 36498 (What 3 Words: valid, lifetimes, sketches). The release land is 1.25ha (12,500m2). The release land is comprised of dry heath with degraded pockets of blanket mire. It is accessed via public footpath and does not benefit from any boundary treatment apart from the quarry fencing to the west of the release land.

SECOND SCHEDULE (The replacement land)

The replacement land is located some 2.4km to the south-southeast of the village of Haworth and 140m to the northeast of the hamlet of Leeming. The replacement land is centred around the grid reference: SE 04329 34420 (What 3 Words: honey, rock, amplifier). The replacement land is 2.72ha (27,200m2). The replacement land is comprised of grazed dry acid grassland. It is accessed via the public highway and benefits from being bounded by drystone walls with gated access.
