NOTICE OF CONFIRMATION OF AN ORDER
(OTHER THAN AN ACQUISITION EXTINGUISHMENT ORDER)
HIGHWAYS ACT 1980
THE BOROUGH COUNCIL OF PENDLE
(NELSON 70) PUBLIC PATH DIVERSION ORDER 2021
On 3 March 2023 The Borough Council of Pendle confirmed without modification the above Order made under section 119 of the Highways Act 1980. The effect of this Order is that it will divert the full width of that part of Nelson Footpath 70 running from a point on the extension of Marsden Hall Road South at grid reference SD 8735 3727 (Point A on the Order Map) in a generally south easterly direction to a pedestrian gate at grid reference SD 8739 3721 (Point B on the Order Map) running to a new line following a constructed footpath between the same points (Points A and B on the Order Map). A copy of the Order and the Order Map have been placed and may be seen free of charge during normal office hours at Number One Market Street, Nelson, Lancashire and on the Council’s website. Copies of the Order and Map may be bought at the price of £1. The Order comes into force on the date on which The Borough Council of Pendle certifies that all the work required to bring the public footpath described in Part 2 of the Schedule to the Order into a fit condition for use by the public has been carried out, but if any person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 10 March 2023, make an application to the High Court.
