LICENSING (NORTHERN IRELAND) ORDER 1996 (Article 22, Schedule 5, paras 1 and 2) NOTICE OF APPLICATION FOR THE TRANSFER OF A LICENCE

Administrative Court Division – Western Petty Sessions District of Fermanagh and Tyrone County Court Division of Northern Ireland sitting at Omagh

TAKE NOTICE that we, POB Retail Ltd having its registered office at 203 Cavan Road, Newtownbutler, Enniskillen, Co Fermanagh, BT92 8FB intend at the Magistrates' Court sitting at The Courthouse, East Bridge Street, Enniskillen, BT74 7BW on 23rd September 2026 at 10.00am to apply for the transfer to us of a licence at present held by Paul O'Brien of 202 Cavan Road, Newtownbutler, BT92 8FB for the premises at 203 Cavan Road, Newtownbutler, BT92 8FB being premises of the following kind according to the Licensing (Northern Ireland) Order 1996 namely premises specified in Article:-

Article 5(1)(b) of the Licensing (Northern Ireland) Order 1996 namely premises in which the business carried on under the licence is the business of selling intoxicating liquor by retail for consumption off the premises.

A protection order authorising POB Retail Ltd of 203 Cavan Road, Newtownbutler, Enniskillen, Co Fermanagh, BT92 8FB to carry on business under the licence was granted on 22nd April 2026 by the Magistrates' Court sitting at The Courthouse, East Bridge Street, Enniskillen, BT74 7BW for the period of six months from the date of the order.

The following body corporate owns the business carried on under the Licence - POB Retail Ltd being a limited liability company of which the following persons are the directors - Paul O'Brien of 202 Cavan Road, Newtownbutler, BT92 8FB And the following are the executive controllers - none.

The owner of the premises is Paul and Jayne O'Brien of 202 Cavan Road, Newtownbutler, BT92 8FB.

The licence will be deposited with the clerk of petty sessions before or at the hearing of the application.

AND FURTHER TAKE NOTICE that any person owning or residing or carrying on business in the vicinity of the licensed premises who intends to object to the transfer of the Licence must in accordance with paragraph 4 of Schedule 5 to the Licensing Order of 1996 serve notice of his intention to object upon the applicant and the Clerk of Petty Sessions not less than one week before the before the time of the Court sitting specified in this Notice.

AND FURTHER TAKE NOTICE that the permissible grounds of objection are such as are specified in Article 22 (6) of the said Order of 1996 namely:-

(a) The procedure relating to the Application set out in Schedule 5 of the said Order of 1996 has not been complied with.

(b) That the Applicant is not a fit person to hold a Licence.

(c) That the business carried on the premises has been discontinued.
