LICENSING ACT 2003 - NOTICE OF APPLICATION TO VARY A PREMISES LICENCE

Notice is hereby given that Bannatyne Hotels Ltd has applied to Darlington Borough Council for a variation of the Premises Licence in respect of:

Hotel Bannatyne, Southend Avenue, Darlington DL3 7HZ

The application seeks to vary conditions attached to the current Premises Licence and remove conditions which are no longer applicable, including amendments to conditions contained within Annex 2 and Annex 3 of the licence.

Proposed Annex 2 amendments include:

1. The licence is subject to all of the embedded conditions/restrictions inherent in the Licensing Act 1964 save those relating to hours that have been amended by virtue of this application.

2. While live or recorded music takes place, the licensee or management shall undertake regular monitoring of noise levels at the nearest noise-sensitive locations. A record shall be kept of any monitoring, including the date, time and location of monitoring; the name of the monitor; and any action taken. Records shall be kept for no less than six months and shall be made available upon request by an authorised officer of Darlington Borough Council.

3. Music only played between 11:00am and 9:00pm which is volume controlled and background only or a solo singer.

Annex 3 -

2. Noise from the licensed premises must not give rise to levels of 5db(A) or more above the background noise level, measured in accordance with BS4142 at the nearest affected residential premises.

3. The sale and supply of intoxicating liquor after 11:00pm shall be ancillary to the provision of substantial refreshments.

4. The licence shall be subject to all former conditions attached to the Public Entertainment Licence that was in existence up to 24 November 2005.

5. Remove the following - to the satisfaction of the Licensing Authority and Durham Police.

6. Remove the following - One of whom shall be on duty when licensable activities are taking place.

Any person wishing to make representations regarding this application must give notice in writing to: Licensing Manager, Darlington Borough Council, Town Hall, Darlington DL1 5QT

Representations must be received no later than 3rd June 2026. The application may be inspected Monday to Friday (excluding Bank Holidays) between 9:00am and 4:00pm at the above offices or online at www.darlington.gov.uk

It is an offence knowingly or recklessly to make a false statement in connection with this application. A person is liable to an unlimited fine on summary conviction if found guilty of such an offence.
