Notice of Application for the Grant of a Licence Authorising the Sale of Intoxicating Liquor by Retail in A Conference Centre

IN THE COUNTY COURT FOR NORTHERN IRELAND

SITTING AT LONDONDERRY

TAKE NOTICE that The Office (NI) Ltd (company number NI667859) having its registered address at 60 Desertmartin Road, Moneymore, Magherafelt, Northern Ireland, BT45 7RB, intends to apply to the County Court sitting at The Courthouse, Bishop Street, Londonderry, BT48 6PY commencing at 10.30 o’clock in the forenoon on 1st June 2026 for the grant of a licence for the premises situated at 60 Desertmartin Road, Moneymore, BT45 7RB being a Conference Centre premises as are specified in Article 2 of the Licensing (Northern Ireland) Order 1996, namely premises for which there is in force a Certificate from Tourism NI stating the premises confirm to the requirements prescribed by regulations made with the concurrence of the Department for the Economy.

AND TAKE NOTICE that this application will be dealt with by the court on 5th June 2026 commencing at 10.30 o’clock.

The Office (NI) Ltd will be the owner of such business whose sole director is Linda Carmichael.

The Office (NI) Ltd is the lessee of the premises from

Robert Carmichael.

A plan of the premises separately delineating each part or parts thereof in which intoxicating liquor is to be sold is attached to this notice in accordance with Schedule 1 to the said Order and Rule 6 of Order 48 of the County Court Rules (Northern Ireland) 1981.

There is in force planning permission to use the premises as premises of the kind specified in this notice for the period during which the licence would be in force and a copy of the planning permission is attached.

AND FURTHER TAKE NOTICE that we intend to apply under Article 44 of the Licensing (Northern Ireland) Order 1996 for an order of the above-named Court directing that, on such days as may be specified in the order the hours mentioned in Article 44 (2) of the said Order shall in addition to those mentioned in Article 42(1) of the said Order be included in the permitted hours for the parts of the premises delineated on the said plan on the grounds that the said parts of the said premises are:-

(a) structurally adapted and used, or intended to be used, for the purpose of habitually providing, for the accommodation of persons frequenting the premises:

(i) musical or other entertainment; or

(ii) substantial refreshment; or

(iii) both such entertainment and refreshment; and

(b) the sale of intoxicating liquor is ancillary to that entertainment or refreshment.

AND FURTHER TAKE NOTICE that any person owning, residing or carrying on business in premises in the vicinity of the premises for which the licence is sought must in accordance with paragraph 6 of Schedule 1 to the Order serve notice of his intention to object upon the applicant (at his solicitor’s address if required) and the Chief Clerk not less than one week before the opening of the court sitting specified herein.

The permissible grounds of objection are as specified in Article 7(4)(a) to (d), and paragraph 4 of the said Schedule 1, namely:-

(a) The proper procedure has not been complied with;

(b) The applicant is not a fit person to hold a licence;

(c) The applicant is not aware of its responsibilities under any code of practice approved by the Department;

(d) The premises are not premises of the kind specified in this notice; or

(e)The premises are not suitable for the sale of intoxication liquor by retail as a conference centre.

In the case of the application under Article 44 the permissible grounds of objection are those specified under Articles 44 (1) and 44 (3) namely that the premises are not structurally suitable to be licensed under Article 44 or that persons residing in the vicinity may not be unduly inconvenienced.
