Notice of Application for the Provisional Grant of a Licence for Premises in which the Business carried on under the licence is the business of selling intoxicating liquor by retail for consumption either in or off the premises



IN THE COUNTY COURT IN NORTHERN IRELAND SOUTH EASTERN ADMINISTRATIVE COURT DIVISION SITTING AT NEWRY

TAKE NOTICE that Clonduff Bar Limited having its registered office at 7 Rathfriland Road, Hilltown, Newry, County Down, BT34 5UR, intends to apply to the County Court sitting at Newry Courthouse, 23 New Street, Newry, County Down BT35 6AD commencing at 10.30 o'clock in the forenoon on the 17th November 2025 for the grant of a licence for the premises situated at 29, Main Street, Hilltown, County Down being such premises as are specified in Article 5(1)(a) of the Licensing (Northern Ireland) Order 1996 namely, premises in which it is intended to carry on the business of selling intoxicating liquor for consumption either in or off the premises.



AND TAKE NOTICE that this application will be dealt with by the court on the 17th November 2025 commencing at 10.30 o'clock.



Clonduff Bar Limited being a limited company of which David Lowry is a director will be the owner of such business.



David Lowry is the owner of the premises.



In accordance with Schedule 1 to the said Order and Rule 6 of Order 48 of the County Court Rules (Northern Ireland) 1981 the Applicant attaches to this notice a plan of the premises delineating -



(a) the curtilage of the premises

(b) the part or parts thereof in which intoxicating liquor is to be sold; and

(c) the part or parts thereof in respect of which an application is made under Article 44 of the Order



There is in force planning permission to use the premises as premises of the kind specified in this notice for the period during which the licence would be in force and a copy of the planning permission is attached.



FURTHER TAKE NOTICE that the Applicant intends to apply at the application for the licence for an order for additional hours as specified in Article 44 of the said Order, namely weekdays from 11.00pm to 1.00am the next day following and on Sundays from 10.00pm to 1.00 am the next day, and on Sunday being 31st December from 10.00pm to 1.00 am the next day following be included in the permitted hours for the part[s] of the premises delineated on the said plan on the grounds that the said part[s] of the premises are:-



(a) structurally adapted and used, or intended to be used, for the purpose of habitually provided, for the accommodation of persons frequenting the premises:

(i) musical or other entertainment; or

(ii) substantial refreshment in the form of a main table meal at midday or in the evening or both

(iii) both such entertainment and refreshment; and

(b)the sale of intoxicating liquor ancillary to that entertainment or refreshment



A subsisting licence as defined in Schedule 2 of the said Order for the premises such as are specified in Article 5(1)(a) situated at 29, Main Street, Hilltown, County Down, will be surrendered to the Court.



AND FURTHER TAKE NOTICE that any person owning, residing or carrying on business in premises in the vicinity of the premises for which the licence is sought must in accordance with paragraph 6 of Schedule 1 to the Order serve notice of his intention to object upon the applicant (at their solicitor's address if required) and the Chief Clerk not less than one week before the opening of the court sitting specified herein.



The permissible grounds of objection are such as are specified in Article 7(4)(a) to (d) of the Licensing Order, namely failure to comply with the correct procedure, unfitness of the applicant, unsuitability of premises and in the case of the application under Article 44 the permissible grounds of objection are as specified in Article 44 (1) and (3) namely suitability and undue inconvenience to residents.
