NOTICE OF APPLICATION FOR THE

TRANSFER OF A LICENCE

TAKE NOTICE that ODM Restaurants Ltd (NI640398), a private limited company having its registered office at 88 Main Street 1st Floor, 88 Main Street, Bushmills, BT57 8QD intends at the Magistrates’ Court sitting at The Courthouse, 46a Mountsandel Road, Coleraine, BT52 1NY on the 19th September 2025 to apply for the transfer to it of a licence at present held by Gareth John Witherow for premises at 34 Newbridge Road, Coleraine (formerly known as 48 Newbridge Road, Coleraine) being premises of the following kind according to the Licensing (Northern Ireland) Order 1996 namely premises specified in Article: -

5(1)(e) a restaurant, i.e. premises other than those referred to in Article 5(1 (a) of the Order structurally adapted and used, or intended to be used, for the purpose of providing persons frequenting the premises with a main table meal at midday or in the evening, or both.



A Protection Order authorising the Applicant to carry on the business under the licence was granted on the 17th day of April 2025 by the Magistrates’ Court sitting at The Courthouse, 46a Mountsandel Road, Coleraine, BT52 1NY for the period of 6 months from the date of the order.



The Applicant shall be the owner of the business to be carried on under the Licence of which the following persons are directors: Gareth John Witherow of 88 Main Street, 1st Floor, 88 Main Street, Bushmills, BT57 8QD. No other person has executive control.



The Applicant is the owner of the premises.



The licence will be deposited with the clerk of petty sessions before or at the hearing of the application.



AND FURTHER TAKE NOTICE that any person owning or residing or carrying on business in premises in the vicinity of the premises for which the transfer of the licence is sought who intends to object to the Transfer of the licence must in accordance with paragraph 4 of Schedule 5 to the Order serve notice of his intention to object upon the Applicant and the Clerk of Petty Sessions not less than one week before the time of the Court sitting at which the application is to be made briefly stating the grounds of objection as specified in Article 22(6) of the said Order, those being:-

(i) That the statutory procedure has not been complied with;

(ii) That the applicant is not a fit person to hold a licence; and or,

(iii) That the business carried on in the premises under the licence has been discontinued.
