Notice of application for the grant of licence for premises in which part of the business is the sale of intoxicating liquor by retail for consumption off the premises NORTH EASTERN ADMINISTRATIVE COURT DIVISION ANTRIM COUNTY COURT
TAKE NOTICE that MUSGRAVE RETAIL PARTNERS NI LIMITED having its registered office at Belfast Harbour Estate, 1/19 Dargan Drive, Belfast BT3 9JG, intends to apply to the County Court sitting at Antrim for the above division, for the grant of a licence for the premises situate at 4 Garvagh Road, Dungiven, Londonderry, BT47 4LT being premises such as are specified in Article 5(1)(b) of the Licensing (Northern Ireland) Order 1996, namely premises in which the applicant intends to carry on only or principally the business of selling intoxicating liquor for consumption off the premises.
AND TAKE NOTICE that this application will be dealt with by the Court on the 1 September 2025 (the opening day for this sitting day being the 29 August 2025), commencing at 10:00am.
1. The applicant company will be owner of such business.
2. The applicant is a private limited company whose directors are:
a. Andrew Keating of Belfast Harbour Estate, 1/19 Dargan Drive, Belfast, BT3 9JG;
b. Noel Keeley of Musgrave House, Ballycurreen, Airport Road, Cork, Ireland; and
c. Trevor Magill of Belfast Harbour Estate, 1/19 Dargan Drive, Belfast, BT3 9JG.
3. The persons having executive control of the applicant company are the directors identified above.
4. The company secretary is Eoin Connolly of Belfast Harbour Estate, 1/19 Dargan Drive, Belfast, BT3 9JG.
5. The owner of the premises is O’Kane Supermarkets Limited of 49 High Street, Draperstown, Magherafelt, County Londonderry, BT45 7AB.
6. A plan of the premises separately delineating each part or parts of the premises as specified in Rule 6 of Order 48 of the County Court Rules (Northern Ireland) 1981 is attached to this notice in accordance with Schedule 1 to the said Order.
7. There is in force planning permission to use the premises as premises of the kind specified in this notice for the period during which the licence would be in force and a copy of the planning permission is attached.
A subsisting licence as defined in Schedule II of the said Order for premises such as are specified in Article 5(1)(b) situate at Supervalu, 4 Garvagh Road, Dungiven, Londonderry, BT47 4LT will be surrendered to the Court.
AND FURTHER TAKE NOTICE that any person owning, residing or carrying on business in the vicinity of the premises for which the licence is sought must, in accordance with paragraph 6 of Schedule I to the Order serve notice of his intention to object upon the applicant (at its Solicitor’s address herein if required) and the Chief Clerk not less than one week before the opening of the Court sittings specified herein. The permissible ground of objection are as specified in Article 7(4)(a) to (e)(i) of the said Order, namely:
a. failure to comply with the correct procedure;
b. the fitness of the applicant;
c. the unsuitability of the premises; and
d. the number of licensed premises which are in the vicinity of the premises is not inadequate.
