NOTICE OF APPLICATION FOR THE TRANSFER OF A LICENCE

TAKE NOTICE that we, Servicepubs Limited whose registered office is at 1c Kings Square, The Poet, Belfast, BT5 7EA intend at the Magistrates' Court sitting at The Courthouse, Regent Street, Newtownards, Co Down, BT23 4LP on 6th March 2025 at 10.00am to apply for the transfer to us of a licence at present held by Clinker Pubs Limited whose registered office is 101 F & G, Main Street, Moira, BT67 0LH for the premises at Kings Square Shopping Centre, Kings Road, Belfast, BT5 7EA being premises of the following kind according to the Licensing (Northern Ireland) Order 1996 namely premises specified in Article:‑

Article 5(1)(a) of the Licensing (Northern Ireland) Order 1996 namely premises in which the business carried on under the licence is the business of selling intoxicating liquor by retail for consumption either in or off the premises

A protection order authorising Servicepubs Limited whose registered office is at 1c Kings Square, The Poet, Belfast, BT5 7EA to carry on business under the licence was granted on 26th September 2024 by the Magistrates' Court sitting at The Courthouse, Regent Street, Newtownards, Co Down, BT23 4LP for the period of six months from the date of the order.

The following body corporate owns the business carried on under the Licence-

Servicepubs Limited being a limited liability company of which the following persons are the directors-
Jonathan Robert Service of 1c Kings Square, The Poet, Belfast, BT5 7EA
And the following are the executive controllers - none

The owner of the premises is North Down Trading (NI) Limited having its registered office at 3 Hill Street, Belfast, BT1 2LA

The licence will be deposited with the clerk of petty sessions before or at the hearing of the application.

AND FURTHER TAKE NOTICE that any person owning or residing or carrying on business in the vicinity of the licensed premises who intends to object to the transfer of the Licence must in accordance with paragraph 4 of Schedule 5 to the Licensing Order of 1996 serve notice of his intention to object upon the applicant and the Clerk of Petty Sessions not less than one week before the before the time of the Court sitting specified in this Notice.

AND FURTHER TAKE NOTICE that the permissible grounds of objection are such as are specified in Article 22 (6) of the said Order of 1996 namely:-

(a) The procedure relating to the Application set out in Schedule 5 of the said Order of 1996 has not been complied with

(b) That the Applicant is not a fit person to hold a Licence

(c) That the business carried on the premises has been discontinued

(i) the DCU Commander at Belfast City District Command Unit, PSNI Station, Musgrave Street, 60 Victoria Street, Belfast, BT1 3GL (district headquarters for the police district command unit in which the premises are situated and in which the Applicant has its registered office).

(ii) Belfast City Council, Cecil Ward Building, 4-10 Linenhall Street, Belfast, BT2 8BP (district council for the district in which the premises are situated).
