Notice of Application for grant of licence for premises in which the business carried on under the licence is the business of selling intoxicating liquor by retail for consumption off the premises

SITTING AT DOWNPATRICK
TAKE NOTICE that we BROSS MORRISON’S LTD (company number NI072354) whose registered office address is 69/77 Belfast Road, Balynahinch, Co Down, BT24 8EB intend to apply to the County Court sitting at The Courthouse, English Street, Downpatrick, BT30 6AB for the above Division commencing at 10.30 o’clock in the forenoon on the 21st day of March 2025 for the grant of a licence for the premises situated at 1 Ballynahinch Road, Saintfield, County Down, BT24 7AE being such premises as are specified in Article 5(1)(b) of the Licensing (Northern Ireland) Order 1996; namely premises in which the applicant intends to carry on the business of selling intoxicating liquor for consumption off the premises.
AND TAKE NOTICE that this application will be dealt with by the Court on the 21st day of March 2025 commencing at 10.30 am.
The owner of such business will be Bross Morrison’s Ltd (company number NI072354) a body corporate whose Directors are Sean William Morrison and Dympna Morrison and whose Secretary is Lana Morrison.
The owners of the premises are Edward Michael Griffith & Catherine Mary Griffith and Hendersons Wholesale Limited (company number NI000068) whose registered office address is 9 Hightown Avenue, Newtownabbey, Antrim, Northern Ireland, BT36 4RT.
A plan of the premises delineating the part or parts thereof in which intoxicating liquor is to be sold is attached to this notice in accordance with Schedule 1 to the Licensing (Northern Ireland) Order 1996 and Rule 6 of Order 48 of the County Court Rules (Northern Ireland) 1981.
There is in force planning permission to use the premises as premises of the kind specified in this notice for the period during which the licence would be in force.
A subsisting licence as defined in Schedule 2 of the Licensing (Northern Ireland) Order 1996 for premises such as are specified in Article 5(1)(b) situated at 1 Ballynahinch Road, Saintfield, Co Down, BT24 7AE.
FURTHER TAKE NOTICE that any person owning or residing or carrying on business in premises in the vicinity of the premises for which the licence is sought who intends to object to the grant of the licence must in accordance with paragraph 6 of Schedule 1 to the Licensing (Northern Ireland) Order 1996 serve notice of his/her intention to object upon the applicant and the Chief Clerk not less than one week before the 21st day of March 2025 being the time of the opening of the Court sittings.
AND FURTHER TAKE NOTICE that the permissible grounds of objection are such as are specified in Article 7(4)(a) to (e)(i) of the Licensing Order, namely, that the procedure relating to the application has not been complied with; that the applicant is not a fit person to hold a licence; that the applicant is not aware of the responsibilities under any code of practice which the Department has approved under Article 76F (and from which it has not withdrawn its approval); that the premises are not premises of the kind specified in the application; that the premises are not suitable to be licensed for the sale of intoxicating liquor by retail; and that the number of licensed premises of the kind specified in the application in the vicinity of the premises is or will be adequate.
