NOTICE OF APPLICATION FOR THE GRANT OF A
LICENCE AUTHORISING THE SALE OF INTOXICATING LIQUOR
BY RETAIL IN A RESTAURANT
IN THE COUNTY COURT FOR NORTHERN IRELAND ADMINISTRATIVE COURT DIVISION OF ARMAGH & SOUTH DOWN
TAKE NOTICE that SALT KITCHEN LTD whose Registered Office is at Unit 1 Cascum Avenue, The Outlet Park, Banbridge, County Down, Northern Ireland, BT32 4GJ intends to apply to County Court sitting at Newry, The Courthouse, New Street, Newry BT35 6JD for the above Division for the grant of a licence for the premises “Salt Kitchen Banbridge” situated at Units 75 and 76 The Boulevard, Bridgewater park, Banbridge, County Down BT32 4JG, being restaurant premises such as are specified in Article 2 of the Licensing (Northern Ireland) Order 1996, namely premises not being premises of a kind mentioned in Article 5 (1) (a) in which there is carried on the business of the selling of meals or refreshments, which are structurally adapted and used for the purposes of providing persons frequenting the premises with a main table meal at midday or in the evening, or both.
AND TAKE NOTICE that this application will be dealt with by the Court on 28th February 2025 commencing at 10.30am.
The applicant is the owner of the business to be carried on under the Licence.
The applicant is a limited liability company registered in Northern Ireland under company number NI637137 whose registered office is situated at Unit 1 Cascum Avenue, The Outlet Park, Banbridge, County Down, Northern Ireland, BT32 4GJ and whose Directors are Gary Scott and Sharon Wright.
The owner of the premises is EPISO 4 Banbridge S.a.r.l.
A plan of the premises separately delineating each part or parts of the premises as specified in Rule 6 of Order 48 of the County Court Rules (Northern Ireland) 1981 is attached to this notice in accordance with Schedule 1 to the said Order.
There is in force planning permission to use the premises as premises of the kind specified in this notice for the period during which the licence would be in force and a copy of the planning permission is attached.
AND FURTHER TAKE NOTICE that the applicant intends to apply at the final grant application for the licence for an order for additional hours as specified in Article 44 of the said Order, namely weekdays from 11.00pm to 1.00am the next day following, and on Sundays from 10.00pm to 12.00 midnight on the grounds the premise are:-
(a) Structurally adapted and used, or intended to be used, for the purpose of habitually providing for the accommodation or persons frequenting the premises:-
a. Musical or other entertainment; or
b. Substantial refreshment; or
c. Both such entertainment or refreshment, and
(b) The sale of intoxicating liquor is ancillary to that entertainment or refreshment.
AND FURTHER TAKE NOTICE that any person owning or residing or carrying on business in the premises in the vicinity of the premises for which this licence is sought, must, in accordance with paragraph 6 of Schedule 1 of the said Order serve notice of his intention to object upon the applicant (at its solicitor’s address if required) and the Chief Clerk not less than one week before the opening of the court sitting.
The permissible grounds of objection are specified in Article 7 (4) (a) to (e) and paragraph 4 of the said Schedule 1, namely:-
(a) The proper procedure has not been complied with;
(b) The applicant is not a fit person to hold a licence;
(c) The premises are not premises of the kind specified in this notice or are not suitable for the sale of intoxicating liquor by retail as a restaurant.
In the case of Article 44, the permissible grounds of objection are as set out specified in Article 44 (1) and (3), namely structural suitability or undue inconvenience to residents.
