Notice Of Application For The Transfer Of A Licence Western Administrative Court Division

TAKE NOTICE that I Barry McGovern of 1 Rectory Court, Letterbreen, Enniskillen, Co Fermanagh, BT74 9ES intend to apply to the Magistrate's Court sitting at Enniskillen on 8 May 2024 at 10am for the transfer of a licence at present held by Paul Leonard of 5 Lattone Road, Belcoo, Co Fermanagh, BT93 5AQ for the premises situate at and known as The Well Bar, Railway Road, Belcoo, Co Fermanagh, BT93 5FJ being premises of the following kind according to the Licensing (Northern Ireland) Order 1996, namely premises specified in Article:-

5(1) (a) premises in which the business carried on under the licence is the business of selling intoxicating liquor by retail for consumption in or off the premises.

A Protection Order authorising the said Barry McGovern to carry on the business under the licence was granted on 8 November 2023 by the Magistrate's Court sitting at Enniskillen for the period of six months from the date of the order.

I am the owner of the business carried on under the licence. The owner of the premises is the said Barry McGovern of 1 Rectory Court, Letterbreen, Enniskillen, Co Fermanagh, BT74 9ES.

The licence will be deposited with the Clerk of Petty Sessions before or at the hearing of the application.

FURTHER TAKE NOTICE that any person owning or residing or carrying on business in premises in the vicinity of the premises for which the transfer of Licence is sought who intends to object must in accordance with paragraph 4 of Schedule 5 of the said Order serve a Notice of Intention to Object upon the Applicant and the Clerk of Petty Sessions not less than one week before the hearing of the Court application.

AND FURTHER TAKE NOTICE

that the permissible grounds of objection are specified in Article 22(6) of the said Order namely unfitness of the applicant, failure to comply with the correct procedure or that the business carried on in the premises under the Licence has been discontinued.
